Election results don’t have to be certified. The constitution lets state legislatures select their electors how ever they want. There doesn’t even have to be a popular vote AT ALL. If the voting gets completely jacked, the state legislatures can call it off. Or they can use the results tabulated. Or they can toss a freaking if they want.

If it is 50-50 in the Senate, then the Constitution is quite clear here. Rock, Paper, Scissors...

The problem I guess is that if you read that carefully, you will see that there is a possibility that NO President will be elected since a majority of the States is required to make a choice. This is what the article says happens in that case:

“But we haven’t forgotten Nancy Pelosi. Sec.3 of the 20th Amendment also specifies that IF neither a President or Vice-President is elected IN TIME for the January 20th Inauguration, then the Speaker of the House becomes acting President until the incoming House selects a President or the Senate selects a Vice-President. This is according to the Presidential Succession Act of 1947. They must continue voting until they do.”

So Pelosi could become President if no one else is elected. But I guess your point is that she would not be “elected” President.

The Founders thought of everything. EVERYTHING.

The House elects the President from the top 3. But what if nobody wins?

The SENATE elects the VP from the top TWO. So, somebody has to win in the Senate.

If no President is elected by the House by January 20,2021 at noon, the VP chosen by the Senate becomes acting President until a President is elected in the House.

In no case does the Speaker of the House become President.

Legitimate court? It’s a very key weakness. How many legitimate federal courts do you think we have after 2 Clinton and two Obama terms with Republicans rubber-stamping every stinking communist they nominated?

Mike Pence is President of the Senate until January 20, 2021 at noon.

Good, good Lord. I don't want it to be this close. (It won't be). But what I wouldn't GIVE to see Mike Pence, at 11:59 am break the tie securing Donald Trump the election. The Beruit explosion would pale compared to the heads of Democrats exploding....

Mark Levin went into a detailed analysis of this on his radio show yesterday (Aug 4). Great analysis. The Great One said (if I remember correctly) Pelosi can’t be president because it’s not voted on by 435 members but by each state. California has 52 congress critters but only get one vote the same as Wyoming with 2 congress critters. There’s 26 red states. Trump should get the majority.

These couple of sentences make no sense:

We also know that Electors cannot be elected by their States in December until the election has been Certified. The results of these elections must be certified and announced by the U.S. House of Representatives on January 6th after the 538 State Electors have announced their Presidential preference.

Yeah, if the elections are so corrupted that there can't be an Electoral College vote, then the Democrat-controlled states will likely have trouble with their House elections, too, while the Republican states that didn't do massive mail-in ballots can still send Representatives to the House. A Democrat-vacant House will select a Speaker from those who were sworn in, which will then be a Republican, while the Democrat states are still sorting out their mess.

Nope. The election will be determined by the states, such that each state shall have one vote, based on which party has the majority of its representatives. The Republicans win, 27-23.

According to Wikipedi: Presidential Succession Act of 1947. An Act To provide for the performance of the duties of the office of President in case of the removal, resignation, death, or inability both of the President and Vice President.

According to this it DOES NOT suggest what might happen if the Electoral College does not vote.

It only means that Electors must be chosen by state parties according to election and apportionment rules in December and sent to Congress for Certification on January 6th

Pence could only break a tie for VICE PRESIDENT (electing himself).

The Senate has nothing to do with electing the President.

Right. If a sufficient number of electors, incoming Congressmen or Senators can’t be certified due to inconclusive elections by January 20th, both President Elect and Vice-President Elect can’t be “Qualified”.Then Speaker of the House becomes acting President until until they can.

THIS ONLY HAPPENS IN CASE OF A CONTINGENT PROCESS. This presumes that electors cannot yet be certified by Congress, and incoming Congress can’t be seated because of delay or contest of vote.

I think that, in the given (unlikely) scenario, it would come down to Pence. Asshole Democrats would push it to the limit.

I thought it was the President Pro temp of the Senate. I know NP is third in line, but I thought this situation was different.

It’s going to be a goat rodeo.
