But I am quite sure that if the reason for denial of service was due to the customer being part of the protected class then such could be prosecuted as Jack Phillips (Masterpiece bakery) was and is for years.
Of course, including a class of persons thus protected on the basis of how they feel and act, versus non-moral aspects such as race, color, ethnicity, nat'l origin, and or being part of a recognized religion (which loses when the conflict it btwn the two), was unprecedented, and opens the door for inclusion of other classes based upon feelings and behavior.
Maybe the Uber driver can claim that his opposition to contraception was due to him/her being "born again" that way...

As a contractor (which he was) you are in an entire different class then a vendor.
I currently act as both vendor and contractor. I sell books, games and other media. You may come into my store and select any thing off the shelf you want and, providing you have the money and are an adult, I will sell it to you.
However I also take contracts to find things. I have customers who want to hunt down signed copies, unrevised copies, first editions and so forth. I will consider what you want and tell you, yes or no. I do not have to take your commission. I can refuse it for any number of reasons and I do not have to explain.

You do understand that regular hormonal birth control pills work exactly the same way right?....right?
Plan B is the same hormone that most birth control pills use but in a much larger dose so it immediately kicks off a period cycle and shedding of the uterine wall. The yellow or green pills in every pack of birth control is the plan B hormone identical in chemicals and function.
Hormonal birth control does not stop conception never has never will. It only prevents implantation due to suppressing the pregnancy hormone and thenough induces a period cycle this is how every hormonal birth control pills since the 1950s have worked.
You don’t even need plan B if you already have a pack of hormonal birth control pills. Why would you need plan B if she forgot to take a pill one day or left them at home while away for a weekend. <<< this happens to married people this one included more times than people think when packing in a hurry.
Take all 5 of the yellow or green pills at once it is then the same dose as a plan B pill pack the woman will immediately cycle into a period and ensure no pregnancy. My wife has done this at her OBGYN instructions when we went to Vegas and she forgot her pills at home rather than just get a whole new prescription in Vegas her Dr said when you get home take all 5 green ones and you will be fine enjoy Vegas. The white pills do nothing to stop conception they only keep the egg from implantation and a placental development cycle from starting this is basic high school level biology.

Meaning, SCOTUS basically said that the attitude of the prosecution was biased, not that the merits of the case was wrong.
Yet if there was any case in which religious exemption would allow refusal to be complicit in celebrating a homosexual union then this was it. For Masterpiece was indeed asked to be complicit (by contracting to create a special cake) in the celebration of an immoral (God's law) and illegal (state law, the CO constitutions at the time) and was and is being punished for refusal to do so.
However, since SCOTUS (via 5-4 vote) wickedly criminalized the refusal to recognize homosex unions, then it finds itself in a quandary when faced with a business which refuses to provide something for that express purpose. Everyone business must make the bed for them.

But you cannot refuse to provide a service offered to others if refusal is based upon protected status aspects. At least if you are a Christian. If that Uber driver refused to provide transportation service to a homosexual wedding then he would be in as much trouble or more than if he refused to provide service to a BLM rally.
