This radical, really pre-Civil War II argument has been developing since just after Katherine Harris certified the Bush electors on November 16, 2000.
One of Gore's lawyers (I wish I had the cite) said, in effect, "it does not matter what the count eventually shows, because everyone knows that a majority of the people (not voters) in Florida wanted Gore to win".
This appeal to the General Will has surfaced in outbursts by angry Democrat leaders again and again since November 2000. Chuck Schumer recently said that "everyone knows the 45 Democrats represent more people than the 55 Republicans", again, negating the whole IDEA of the Senate and appealing to the General Will.
This is a destructive and revolutionary doctrine, which has caused catastrophe again and again, in France, in Russia, in Germany, and all over the world. The US is no different.
The Democrats no longer believe that actual arithmetical counting of real votes by real, legal voters, confers legitimacy. They will not cooperate in the administration of governments so chosen, and when they have the opportunity, they will cheat without remorse (cf. Dino Rossi), convinced that a higher power (the General Will) validates their obstruction and their cheating.
It takes a long time to become reconciled to losing power. It took the Republicans 20 years after 1932 to organize effectively as a minority.
But this Democratic strategy, IF they keep losing and IF they keep it up, will lead to civil unrest or even war.
It is unconscionable.

Senators Work on Filibuster Compromise

WASHINGTON (AP) -- Two of the Senate's senior statesmen, Republican John Warner and Democrat Robert Byrd, are stepping to the forefront of efforts to avert a showdown over whether an out-of-power party can use Senate filibusters to effectively thwart a president from reshaping the nation's courts to his liking.
But time was running out on Byrd and Warner's attempt to bridge warring senatorial factions, with Senate Majority Leader Bill Frist, R-Tenn., starting a countdown Friday on how long senators would debate Texas Supreme Court Justice Priscilla Owen's nomination to the 5th Circuit U.S. Court of Appeals.
If senators are forced to vote next week on Owen's nomination to the New Orleans-based court, centrists say a historic confrontation is sure to follow over whether filibusters of appellate and Supreme Court nominees should be prohibited during the rest of the Bush presidency.
"Once you start into the procedural votes, the real procedural votes on the first judge, then it's going to be very difficult to put the genie back into the bottle," said Sen. Mike DeWine, R-Ohio. "I think most of us look at that as once you have that first vote, it's going to be very difficult to get a deal done."

Frist was expected to announce Friday that the Senate would hold a test vote on Owen on Tuesday, and if she doesn't garner 60 votes - the threshold for overcoming a filibuster - he then will move to have the Senate declare that filibusters are illegal for Supreme Court and federal appellate court nominees - a change that has been labeled the "nuclear option."
The Republican-controlled Senate has been debating Owen's nomination since Wednesday. "We will continue that debate," Frist said. "Ten hours, 20 hours, 30 hours, as many hours as it takes for senators to air their views. But at some point, that debate should end and there should be a vote."
While it takes 60 votes to overcome a filibuster, Republicans intend to supersede the rule by a simple majority vote. With 55 seats, Republicans could afford five defections if all 100 members vote and still prevail on the strength of Vice President Dick Cheney's ability to break ties.
Democrats have threatened to slow the Senate's business to a crawl if Republicans prevail, and they served up a preview this week by invoking a rule that prevented some committees from meeting.

You are so right, cc2k. Most of the Republican senators in the long procession of speakers are not using their pulpit and time to their advantage. This doesn't surprise me as the Republican party honchos and honchettes stink at PR and always have in recent times.
Our side's speakers should quit boring people to death with all the inside intricacies of the rules, history, precedent, blah blah ad infinitum. Each Pubbie speaker is basically repeating the same standard stuff as the prior one.
Cut to the chase, guys. Tout the nominees, make the Dems look like arses for opposing the nominees, go on the offensive on the Dems offensiveness and stop making our eyes glaze over with minutia.
No need to use a hammer. A stiletto perfectly placed is just as effective, if not more so.
Most importantly, speak over the heads of the 'Rat senators by talking directly to the American citizenry through the Chair and with decorum.
Reagan knew how to do this.

Not sure what you're looking for here. FIF, I purposely browse FR with a "lame" browser (lynx) so as to get the text and skip the graphics. I do run a graphical browser too, at the same time, so could probably find the article you want to post, but it helps to have a URL to get started. I don't visit any of the media outlets on a regular basis. FR, CSPAN and chatrooms are my sources of news. I go to raw source on an issue by issue basis.

There's another way of looking at it.
I think Warner is right where Frist wants him---in a position to keep an eye on what the negotiators are up to. Some have compared this to a 3 dimensional chess game. A critical element in chess is anticipating the moves of your opponents. Frist surely anticipated that the "moderates" would begin negotiating with the rats. So he probably chose Warner months ago to be his "inside man". For all we know, Warner is the most valuable tool we have right now.
Let's let this play out before we start eating our own.

Warner, R-Va., and Byrd, D-W.Va., are trying to craft language on another part involving an exchange of "good faith" pledges by lawmakers. Democrats would agree not to filibuster future appeals court or Supreme Court nominees except in extraordinary cases. Republicans would agree not to support any changes in the filibuster procedures, although it was unclear what circumstances, if any, would permit them to change their minds.
Warner, as he went in and out of meetings in the office of Sen. John McCain, R-Ariz., refused to talk to reporters. But Byrd acknowledged he was working with Warner and said their language could be the "nuclear shield."
"It might prevent the nuclear option from ever being detonated," said Byrd, the chamber's most senior senator.
Byrd also suggested he and Warner were working on language where the president would pick his court nominees from a pool of suggested candidates "possibly selected on the basis of discussions with state and federal chief justices, lawyers, people from academia and so forth."
