As to when Ginzberg will retire ...

You are so right that Justice Ginzberg will try to time stay on the court until a Democrat is in the White House.

But, if we can elect a Republican in 2008, that day may be pushed far enough off into the future that she might relent (if she doesn't fulfill the term of her appointment).

Even replacing her with a moderate would be an improvement.

Plus, she will get nailed over her law degree. Marquette isn't even considered the "better" of the two law schools in state of Wisconsin

Who cares, she's got over 20 years of record, which trumps which school she went to any day. School rating is for new hires, not experienced personnel. For those you look at accomplishments.

Any nominee that is more orginalist than O'Connor. Which isn't difficult to be. Another O'Connor, Souter or any (other) "living document type, would sail through.
