While you might be able to cook up a scenario in which a responsible driver hits a person from behind without fault, the odds of this certainly approach astronomical.

Well, when the law predefines that, in a rear-end collision "fault" always lies with the car in the back...yeah, then it's a LITTLE tough to figure how it could happen and the car in the back NOT be assigned "fault".

I've seen a lot of these drivers roaring down the fast lane 2 feet off the bumper of the car in front. They have NO perception of what will happen if the guy in front has to hit his brakes.

Here is an update. I think Brandy ought to pay a huge settlement to the family of the dead mother, paying for the child's childcare and college and every other thing the kid wants. But I don't think she should be charged or prosecuted in this case, it looks like a hideous accident on the 405, exactly the kind of thing that happens in one's worst nightmares. I think it was totally unintentional and she doesn't deserve this kind of trouble, which must be devastating to everyone involved. Have Brandy pay plenty, but not be charged like some criminal. If I were on the jury, I'd let her go right off, right there. It was an accident.

I can not dispute your logic. However, the brakes could have malfunctioned or any one of a thousand other things could have contributed to the accident.

I admire anyone who accepts blame, as this young lady did.

Also, the car was struck by another car. Yes it probably was Brandy's fault, but was the other car speeding?

Lots of issues here, but after she just caused someone's death, she takes the blame, just got to say she had character if not legal sense.

I'm aware of the scams, but they prey on people following too closely.

I try to be a very careful driver and leave plenty of space between my car and the car ahead of me. The problem is that cars keep swooping into that space! Add to that the idiot riding my bumper from behind and it's about enough to make me stop driving altogether!
