I recall that also. The paragraph you posted is significant. While cell phones are currently being targeted, there are many things people do in cars that distract them; eating, smoking, changing CD's, fumbling for keys, looking at maps, and on and on...
Pretty soon, any traffic accident will involve a prison sentence for whoever is deemed "at fault".
No, "My Bad" doesn't make it better, but nothing here says it was anything other than a tragic accident. Even talking on a cell phone, as much as I hate seeing people needlessly doing it, doesn't even come close to gross negligence. Unless she was on something or traveling excessively over the speed limit, this is an accident that should not result in criminal charges. Though I've never heard of misdemeanor manslaughter before, its obviously not a very serious charge and even if found guilty, she will get probation at the worst.

I agree with your response to my snarky comment. And if she were not a celebrity noone would ever know about this and charges may not have ever even been considered.

There is absolutely no reason to hit someone from behind. If you hit someone from behind, you have done something wrong.
Maybe she was talking on the phone, maybe she wasn't--but because she hit him from behind, I would be willing to bet any sum of money that she was following him too close. It's illegal to follow too closely and if she broke the law, someone died because of it. That's negligence and she ought be punished.
I think she should be punished a bit more serverely. Why is it that we punish DUI'ers for what they MIGHT do, and crappy drivers who DO cause accidents don't face any charges.
There are plenty of crappy drivers out there that should be punished for causing accidents, beyond just raising their insurance rates.
The Sugarcubes (from Iceland, not Finland) were Bjork's original band. She's kookoo, so it makes sense.
