None of the stories have stated the Honda was stopped.
They were all traveling on the 405, when traffic slowed and Brandy hit the back of the Honda.
But how can one measure or achieve consistency concerning such an intangible and varying emotional element? Some people may accidentally kill others and 'get over it' surprisingly quick. How is that punishment? I understand what you're saying but it assumes far too much, IMO.
When another driver disregards the law by speeding or following too close, I've no longer accepted that risk. I don't bargain for people slamming into me from behind--I don't accept that risk, because that risk does not accompany lawful driving.
Also, it seems like Brandy's actions here fit perfectly within the misdemeanor manslaughter rule: she committed a misdemeanor (following too close) and someone died as a result of her action. Sounds like this is practically a textbook case.

Not trying to be snarky, but, in California following to close is a traffic infraction, not a misdemeanor

It wasn't following too close which was the problem. It was what happened shortly thereafter.

Yeah, I remember it too. Broderick was driving on the wrong side of the road. He had forgotten that in Ireland they drive on the left side, just like in Great Britain.
Admittedly, I only read the headline, but I think this sets a bad precedent. We've blamed the vehicle, the bartender/owner, and now we're going to blame the actual intoxicant?

Thats the whack job everybody was trying to convince us that she was smoking hot. Personally I wanted a drink of what everybody saying she was hot was drinking. Never did get it.
In NC, if you rear-end someone the charges are "following too closely" and "careless and reckless driving". They are NOT minor infractions, especially if an injury or death results. This is repeatedly emphasized in all drivers-ed courses - you are always responsible for maintaining a safe stopping distance behind any vehicle, in any conditions.
