None of the stories have stated the Honda was stopped.

They were all traveling on the 405, when traffic slowed and Brandy hit the back of the Honda.

I think knowing that your negligent actions resulted in someone's death is far worse punishment than some legal probation

But how can one measure or achieve consistency concerning such an intangible and varying emotional element? Some people may accidentally kill others and 'get over it' surprisingly quick. How is that punishment? I understand what you're saying but it assumes far too much, IMO.

I do accept risk, but I only accept certain levels of risk--i.e., I accept the level of risk that is associated with me and everyone else on the road following the law.

When another driver disregards the law by speeding or following too close, I've no longer accepted that risk. I don't bargain for people slamming into me from behind--I don't accept that risk, because that risk does not accompany lawful driving.

Also, it seems like Brandy's actions here fit perfectly within the misdemeanor manslaughter rule: she committed a misdemeanor (following too close) and someone died as a result of her action. Sounds like this is practically a textbook case.

It wasn't following too close which was the problem. It was what happened shortly thereafter.

Well, I guess I'm going against the flow here, but nobody here has ever rearended someone totally by accident? A cell phone is not necessary to do such a thing. If it's her fault she'll pay. But I won't tar and feather her.

Yeah, I remember it too. Broderick was driving on the wrong side of the road. He had forgotten that in Ireland they drive on the left side, just like in Great Britain.

If you pay attention and drive at a safe distant, there is absolutely no reason to plow into the car ahead of you who has slowed down.

Maybe she was talking on the phone, maybe she wasn't--but because she hit him from behind, I would be willing to bet any sum of money that she was following him too close. It's illegal to follow too closely and if she broke the law, someone died because of it. That's negligence and she ought be punished.

In NC, if you rear-end someone the charges are "following too closely" and "careless and reckless driving". They are NOT minor infractions, especially if an injury or death results. This is repeatedly emphasized in all drivers-ed courses - you are always responsible for maintaining a safe stopping distance behind any vehicle, in any conditions.
