Yes, wanting people to stand trial when accused of a crime is lunacy. You got me there!

BTW, you never answered Hemmingway’s Ghost. Is it because ghosts are not considered legal residents?

Anyhoo, he wanted to know if the charge had been murder or some such, would you want the employer to face trial? Or does the illegal status of the victim clear them for any and all violations by us REAL citizens?

While illegals should have human rights, at the same time are they entitled to our constitutional rights?

Because the Constitution doesn't vest (all) rights - those are naturally given.

This might explain why I didn’t get any.

Look, you’re probably a nice person who I would agree with on a lot of points. I think you let your anger about the illegal immigration issue cloud your vision on this case though.

Saying they should dismiss a sexual harassment case based on the victim’s residency status makes your outlook seem a bit draconian and anti-human.

Agreed. However I believe sexual harrassment lawsuits are a stupid idea. They are a full employment bill for attorneys and are subject to just too much abuse.

We should simply remove any workers' compensation limited liablility from tort lawsuits for intentional infliction of emotional distress and deal with these lawsuits under common law principles.

I have a saying that will probably get me banned:

No jude, the worst thing about illegal immigration is that we have been inundated with millions of people who have no patriotic or historical ties to our distinct American culture and they have taken over our schools and our public facilities and they are literally in one generation transforming this great country into a potential third world bannana republic.

Our country is crowded enough without this uncontrolled influx of people who are stealing our jobs and depressing the wage base of legal immigrants and citizens. These people are not simply doing jobs Americans won't do. They are bringing down the wages so that legitimate Americans can no longer afford to do those jobs.

I used to wash dishes. I used to fry tacos. I used to mow lawns. I used to work in fast food. I used to drive a forklift.

Now I could not get any one of those jobs because I am not qualified.

Do you want to know why?

BECAUSE I CAN'T SPEAK SPANISH!

I can fix your wagon.

I’ll hire you to mow my lawn (under the table, natch.. $4.00 an hour plus all the grass clippings you can eat), but my gay friend gets to come over and sexually harass you.

If you don’t like it, I guess you could always get a real job. You know, one that isn’t basically reserved for pimply teenagers.

In regard to sexual harrassment, that is my point. You can quit. You can get another job. You can kick the guy in the groin. You don't need federal protection. You have common law and worker's compensation protection, yet these sexual harrassment laws turn a friendly flirt into a federal case.

Oh, that reminds me. I used to work in a flower shop and my gay boss did harrass me. I thought it was funny. He wanted me to pose nude for him (he claimed to be an "artist".) He was willing to pay me 10 times what I made as a delivery boy to pose nude for him. He'd bug me about it at least once a week. I'd just laugh at him. It went with the territory.

I hired him to do the flowers for my wedding.

Well, it’s been fun.. but it’s quitting time and I’ve got to go chat with the fiancee. Since you’re not biting on the lawn offer, I guess it’s up to him to make sure it’s mowed.

I did my job and he paid me. The sexual harrassment was free. It gave me something to laugh about.

Except for the fact that he was a bit queer, he was a good boss. I liked working there. But alas, I had to quit to get a better job. Even after I quit, I used to go there and work Mother's day weekend for fun and some extra cash. (Mother's day for the flower business is like Christmas to Wal Mart)

IIRC he probably harassed me then too.

Big deal.
