To commit fraud requires intent. Not sure I see any intent to defraud here. I think if I had been told my whole life that I was a citizen, I wouldn't have had any reason to suspect otherwise.

Not prosecuting illegal aliens who break the law entering the US illegally fosters the notion that non-citizens can decide which laws apply to them and which do not.
She may have unwittingly broken the law against non-citizens voting but she still thinks the law doesn’t apply to her.
In her view it is just a ‘’misunderstanding.’’

I guess she (like 12 million others) think they get Squatters Rights that trump our laws.
Deport her and any other non-citizen that votes illegally.
They violate the civil rights of citizens by negating the legal vote of a citizen.

You've just touched on a subject that makes me very angry. I've done a lot of research on illegal voters, and I believe the GOP lost the House and the Senate because of illegal voters. ACORN is at the center of a great deal of illegal voters.
This is another example of our government writing laws that they NEVER enforce!
That’s a situation I have some sympathy for. If she had been led to believe for her whole life, that she was a citizen, and she is a legal resident, then I think there ought to be something that could be done. It must have been quite a shock to her to find out.
I realize that could open a whole can of worms, and that’s why I favor deporting all illegals now, by the family, even.
1. She came from Cuba with her parents when she was age 1 (around 1967). [I don't think Castro was sending birth certificates along with all refugees!]
2. Her parents and all of her siblings became naturalized citizens.
3. If she never applied for a passport, I'm not sure why she should know she wasn't a citizen. If her parents were, and told her she was, why should she know different?
4. By way of example, lots of folks are citizens because their father was. Suppose you were raised by a family, always told you were their child, born when dad was abroad, and when you're 40, it turns out you were adopted without formalities. So you're not really a citizen. What punishment?
What this story emphasizes is that we are not (so far) a society, like many in Europe, where everybody has an identity card that gives you all of your status and data. Maybe we should be -- a lot of people think so, and a lot think to the contrary. But many things about immigration policy are not so easy because of that fact.
I'm not saying that a lot of other things aren't easy to decide. Buildng the fence is a no-brainer. But exactly how to figure out who gets to examine who is a citizen or not, and in what ways, is not always easy.
PS -- I checked on the town where she was on the City Council -- it's marginally GOP, in San Bernardino county. Her election was non-partisan.
