Regular drinker has virtually no effect on BAC. As a former defense attorney I worked directly with DUI charges in over 1000 cases. With 2 glasses of wine (in 1 hour) I would NOT take the chance. Or with 2 beers (in 1 hour). Or with one ‘stiff’ bar drink in 1 hour. We here in AZ boast? the most stringent DUI laws in the country due mainly to a very active MADD group.
In my dealings with these idiots, I have found them to be even more radical than the tree-hugging faction by far. Totally irrational and out for blood. Most claim (often falsely) that they ‘had a daughter/son killed by a drunk’. In many cases the drunk was the kid driving their car who was as drunk as the family member killed. In some cases the drunk got drunk at the MADD mother's home and sometimes with their knowledge.
It seems that they are on a guilt trip and trying their damndest to transfer that to others.
I have had clients who were drunk but were broadsided by a sober idiot. Of course the fact that the sober kid caused the wreck is of no consequence.
I have serious questions about the current IR5000 breath test machine and if I was to take one, I would demand to see ALL calibration and performance records from both before and after mine.
As to blood testing, that is almost foolproof IF the chain of custody is clean. Very Happy New Year, everyone.
It should be mentioned that MADD soon became far too radical for its founder, Candy Lightner.
I was pulled over in Arizona, and they were writing me a warning. Just before they were finished, they wanted to look into my mouth. They asked me when was the last time I smoked pot. I told them I wouldnt answer. Then they wanted me to stand on one foot. But I couldnt because I was nervous at that point, because I knew they were going to search my car. And I loan my car to these gypsy girls, and I hadnt had a chance to sweep it for contraband since they last used it. They gave me a breathalyser, and I blew a zero. They cuffed me, towed away my car ($500) and threw me in jail for 24 hours. In the report, the cop said he noticed my eye twitch.
Charged with a DUI, and I was stone cold sober.
Trial is January 6th.

That seems a little much, but what is so difficult about not driving after you have been drinking? DWIs are very, very expensive. Why risk it?
You think the founding fathers would have thought that the right to travel the highways was a privilege and not a right? So since it is a privilege, should they also be able to stop and search and fingerprint you for no reason?
So if we break no laws, it’s OK for us to be abused by police?
We are talking about the ACCUSED here. Or, not even the accused. They do checkpoints and stop everybody.
You are correct. I don’t know what I was thinking when I typed that . . . but I have been drinking, and enough to only walk past my car as I get another beer from the garage. (It’s 16F outside).
As the rest of traffic enforcement, the point isn't to catch the most dangerous offenders. It's to catch the most offenders.
To figure out why, just follow the money.
Use a designated driver and quit bitchin'.
So are you against the checkpoints or arresting people for DWI?
What about making the laws more sensible and enforcement fairer?
Oh come on, you know we haven't a system of positive rights. The Constitution guarantees no one any rights with regard automobiles. Or airplanes. Or radio.
One glass of wine does not make one INTOXICATED!!!
That’s a pretty generalized statement. What specifically are you talking about? DWI in most states is .08. How is that not fair enforcement?

If you are arrested after having one glass of wine, your blood level is not .08
