Sorry for my less than appealing post, however I resided in MN November 2008 and know the fraud strength within the liberal machine. My hunch is that starting Tuesday evening (if not sooner) our RAT crooks will make yours look like Boy Scouts by comparison.Because this seat *does*,in fact,belong to the Senior Senator from Chappaquiddick.

My thinking is that since Mass. was one of the original 1912 signature states of the amendment forcing the people of a state to elect Senators that to delay that vote would in effect be contrary to federal law.
In addition if that delay caused legislation to be approved or denied such as allowing obamacare wouldn't that legislation then become null and void?

Exactly, I tired to do a quick search on the law as to how quickly a Senator who has won has to be certified but did not find anything.
Still, IMHO,as a proponent and signatory of the law in 1912 Mass. should be bound by elections. If they subvert those elections is the result constitutional?

I certainly hope the RAT party tries it. Talk about a firestorm come Nov 2010. The guy sitting in the Senate from MA was not elected by âWE THE PEOPLEâ (after the RAT party reneged on the change of MA election laws).

I think it’s a total of 15 days. Ten days to receive all absentee and military votes, then another 5 days for the precincts to get their final totals to the SoS. So, that means Feb 3 or 4 is the earliest date Brown can be certified.
In the meantime, Kirk cannot vote.

Methinks if they try to delay Browns seating, it is truly time to grab the rifles and head to Mass en masse. Unfortunately, if you don't pax taxes in Massachusetts, its none of your business how they choose to represent themselves.

Actually...it doesn’t matter...after Tuesday Kirk CAN NOT VOTE...it is clear in the constitution once there is an election...the appointed person is out. It does not matter about the state certification...Kirk can not vote.

Unfortunately, if you don't pax taxes in Massachusetts, its none of your business how they choose to represent themselves. That's not quite true. Elections for federal offices (as opposed to state or local offices) potentially affect everyone in the country, not just the people in the particular state in which the election occurs.
Thus, the SCOTUS could and did take juridiction in the 2000 presidential election from the Florida Supreme Court, ruling 7-2 that the remedy proposed by the FL Supremes was not constitutional.
