Many states have a statutory fine of about $350 to $500 that can be collected in such cases by the employer without recourse to a court of law.
It is possible to challenge the claims in court but that requires hiring a lawyer, and so forth. Turns out its CHEAPER to just pay the company that bought the "fired personnel list" than to fight them.
At the same time these guys (in the personnel field, but maybe not RightHaven) are easily frightened away ~ reason being that even the slightest harm to them is going to be MORE COSTLY than the claim they are collecting on, or any damages they can likely get out of someone who has been dismissed from his job.
One trick you can use with them is find out (on the internet) who has an office next to theirs and send them a letter inquiring about the safety and reliability of the individual who signed the letter.
By now I suppose everyone knows everything there is to know about RightHaven, and minor inquiries to the neighbors probably won't do much ~ those people already know about 'em Fur Shur ~
The fact the original owner licensed the copyrights on his articles by leaving URL references suggests that a response by "just anyone" would be to file a counterclaim on a specific piece of which RightHaven has made a claim. Actually two things possible here ~ they're violating your use of the license granted by the newspaper (by giving you a URL to refer to and encouragement to advertise it to your friends, and the newspaper "sold" the exclusive rights without notifying all the other license holders. Should be some money in that one.
Not shoplifting law, but copyright law. Analogies, in the broadest sense, work, but not in detail. When it comes to text on the internet, violatins are too easy, so it is reuired you give your target notice first (with some exceptions for commercial use ~ then it’s a little harder).
I think most of us are simply PO’ed that some scat-brained lawyer is trying to stop us from talking about the news. Crud like this is probably our best bet to get the DMCA taken down. With a little luck, Righthaven will get slapped down, and their boss disbarred.
