No he swerved right, lost control and went back left...the Honda was driving 95 mph and was headed straight at him he would have hit the Avenger head on had this man not swerved..and we also don´t know that he was intoxicated..as others have pointed out no one smelled alcohol for five hours to prove DUI they would have had to have him under constant observation, and that doesn´t seem likely since there was no alcohol smelled on him for five hours.
how do you know he was impaired if we don´t know the results of the test and they weren´t taken for five hours after the accident? No, the accident wasn´t his fault..even authorities have determined the fault is that idiot Gold Honda that was headed at him going 95mph that caused him to swerve in the first place..how quick would you be able to think and react with a car coming at you head on at 95mph? Lots of sober drivers have been killed in exactly that type of incident.

yes, they smelled it FIVE hours later..how do you know he didn´t drink AFTER the accident? Don´t people usually get tested at the scene? What bs...how would it work for you if you have a wreck, go home, have a drink, then the police come to your door to ask you some questions about it five hours later and arrest you because you smell of alcohol and they then say you are suspected of drunk driving...we still don´t know the results of the test either..surely it would have already been released if he had been over the limit...
Once again, CHP have stated numerous times the driver smelled of alcohol hours after the collision..This means pancho is a killer if CHP is correct, which clearly would indicate Jose was impaired.
If you have a problem with this, feel free to call CHP in the area, and call them liars.

Yes, because they already knew he wasn´t at fault from eye witness and video testimony...they knew that the person they were looking for was a GOLD Honda...he was a victim and they sent him to the hospital in an ambulance.
several hours after the collision isn´t going to get it in a court of law..they are not giving any results out right now because they need to send it away and it is going to take two weeks to get back..that is the code word for it was negative and they didn´t like that result so they are sending it elsewhere for testing. Actually it doesn´t mean anything you alledge. If you had a beer before you go home and some idiot comes up and plows into you head on going the wrong way in your lane who is at fault you or him?

read the link that I just provided to you..in it both the five hours later and the fact that he isn´t being held responsible is there. The fact that you can´t use a test taken five hours later is already decided case law.
here is a case where an officer wasn´t suspected of being drunk and later it was shown that he was, but the blood test was still thrown out because they had not suspected him at the scene...just like this driver, except we don´t know the results here yet, but they also did not suspect him at the scene either.
