I am not a lawyer; however, it seems to me it is tactically advisable to ASK for (or “demand” ...wonder if that was the media’s term or Herman’s lawyers???) the phone records; then, if your analysis is correct, and Ms White (or her lawyer) refuses that makes HER look like she is hiding something ...not Herman.
If you go w/the full blown lawsuit initially it will be perceived as Mr Cain using his high powered attorney to silence Ms White (particularly w/the media predictably taking Ms White side).
So, as I see it, you ask for the records; then, if/when Ms White refuses; you file a lawsuit ...and, that way, if Ms White’s lawyer delays or attempts to obfuscate the onus will be on Ms White; not Mr Cain.
What records would she have?

Yesterday it dawned on me that when Bachman was up in the polls there were all these stories about her getting the name of a town wrong, something about Elvis I recall, just things to make it sound like she was saying the stupidest things all the time. Now, however, we hear nothing about her saying things in error. I assume she is still out speaking and campaigning. So are we to believe that she just had a sudden burst of saying dumb things that happened to coincide with her high place in the polls? Mysteriously it seems that rising in the polls “causes” candidates to have fumbles that are turned into big news stories. All that is left is to give this “syndrome” some sort of name like High Poll Bumbling Syndrome, HPBS.
I guess Cain could sue the media for...?...Well, for interviewing him I guess.

My point really was that my cell phone bill has no indication on it of whom I called, or who called me. I'm paying it now. They use nine pages essentially to tell me nothing more than how much I owe them for the month.

I find it amazing how all these so called,

have absolutely NOTHING to prove it's valid and there are still people that say the facts do not matter. It's based on the NUMBER of accusations that count. You know kind of like Salem, Massachusetts during the Witch Trials.
How can anyone with a single ounce of objectivity even take anyone serious when they make such a dumb and overtly bias comment. Can you imagine if our courts operated this way?
