Never forget Issa is a multi-millionaire and as such on the radar of the IRS. See how it works?

Like a mob vig collector. That is what we have let them become.

She did quite a lot “wrong” and knows it. And why she invokes the 5th to prevent penetrating cross exam (they having found out perhaps what is known about her and more to come).

The only possible good out of this today... was, after the 5th was plead, Issa then held up her printed testimony to the IG and had her authenticate it..which she did right there in committee. Issa then implored she consider she waived her right to testify and to re-consider with her attys. She did and then said again— will not testify.

The IG report and her prior sworn testimony might have the makings of a “deal” to get her to spill. Or not. A sharper prosecutor would have done different. Freepers comments?

Does that mean that next year when it is time to files my taxes I can plead the fifth and not file? I’ve done (and won’t do) anything wrong but I don’t want to incriminate myself.

I have been posting on more than a few times that Issa is all bark and no bite. i am still waiting to hear of one of his vaunted investigations that have resulted in a perp walk. Issa is useless to conservatives.

Actually, Issa did the right thing, because now there will be no useful way for criminal evidence to be excluded at trial. And if Issa is willing, there will be a criminal investigation, leading to a trial, under the auspices of a special prosecutor.

A special prosecutor is created by a federal judge, in this case, at the request of the committee or the entire House of Representatives, I’m not sure which.

In this case, request for a special prosecutor will be sent to the United States District Court for the District of Columbia, to its chief judge, Royce C. Lamberth, who may issue it to one of the other judges, or hear it himself.

Absolutely. It would have made more compelling news footage if she had to plead the 5th for every question thrown at her.

Instead she claims her innocence, pleads the 5th once and walks off. This is a House committee. Why is she being allowed to get off like this?

Oh yeah we don’t want the LIV and useful idiots to feel sorry for her for invoking the 5th fifty times.

Issa has accused Lerner of misleading Congress on at least four occasions in response to the committee’s questions last year on whether the IRS was targeting conservative groups.

Sounds like she's already testified on the subject... she can't really invoke the 5th at this point, can she?

Exactly servo. I am already seeing the video of her giving her self serving
statement on news channels in heavy rotation with very little of her pleading the fifth.
If you are not going to get real answers from her, at least get some campaign material.
Issa got neither!

I don’t think that many people here see the political UPSIDE of her taking the 5th amendment. This is not supposed to influence a jury (ha) but it sure as heck influences the court of public opinion.

There has been more than enough material in the last two weeks for a SPECTACULAR 2014/2016 Republican media blitz.

The optics here are that Obama and his administration are at the least, stupid, ignorant, and incompetent liars, and at worst, evil, manipulative, and using government as a tool of oppression. The optics happen to match the reality here, and no amount of manipulation by the finest minds at the DNC can possibly change this. Obama is pinned down and on the defensive until 2014, and a lame duck after that - which, in my opinion, is the best possible outcome of all of this. Obamacare will be crippled or entirely eliminated. The stock market agrees with me.

I suspect that many members of Obama’s administration will be heading for the exits, as well as MORE democratic politicians as soon as it is politically expedient to do so. This will NOT look good on their resume’, and they have a long career ahead of them and there will be a much smaller number of “reward positions” in the future. There are only so many guest commentator positions available on MSNBC, and they don’t pay well either.

Thank you for posting this. After doing a bit of research, I think that Trey Gowdy is correct.

There is a law review article published in 1988 that dealt with waiver of the Fifth. Lerner should have stopped at giving her name and address. Anything more, in the view of the law professor writing the note, her prior appearances under oath, jeopardizes her claiming the Fifth.

I believe I heard Issa dismiss her by continuing her requirement to appear, subject to the committee consulting its counsel.

Correct me if I’m wrong but if you give immunity from prosecution on what is asked you can compel them to testify but they are open to perjury on that testimony

as for giving a statement before claiming the fifth the statement would simply be struck from the record...I believe you can take the stand and testify and if there’s a particular question you feel would incriminate you can claim the fifth on a given question.

But I don’t think you can blanket take the fifth if you’re asking questions that cannot incriminate you, like what’s your name, what’s your job, who do you speak too , who is your boss

And you can’t take the fifth to keep from testifying about other people
