This is the first letter released by Hector & Michaels attorney. What it doesnt mention is that both of them were vindicated by the Essex County Prosecutors Office on November 18th. The exact wording on the declination letter is We conclude there is insufficient credible evidence to warrant a prosecution.
Hector was then suspended without pay pending termination on December 3 and Michael was suspended without pay pending termination the following day.
Michael was offered a deal of a lengthy suspension instead of termination but refused as he would not admit to any wrongdoing.
The day they were vindicated by the prosecutors office was the first time anyone from Bloomfield PD had spoken to them of any problems with their military leave time- although evidence shows Bloomfield had been investigating their military activities for at least a year and a half.
Their attorney was present at this Internal Affairs interview and offered documentation to the investigators to show they were covered by the military. The investigator refused to look at any of the evidence. This is actually on a digital recording!
The Bloomfield Police Department says that Hector and Michael took military leave time from the department when they were not on military leave. This is not true. The Bloomfield Police Department has all the documentation to prove both Hector and Michael were where they were supposed to be at all times and 100% legally covered by the military.
The Bloomfield Police Department is basing their case on their misinterpretation of USERRA and assumptions of wrongdoing with NO evidence. The Bloomfield IA investigators are even on digital recording on Dover AFB admitting to the JAG that they have no military leave policy in place. They have that recording as well.

Senator Rice vowed to have the state Attorney Generals Office investigate Bloomfields internal affairs and Chiefs office.
At 2 pm on December 23, attorney Cathy Elston received confirmation from the Bloomfield Township Attorney Brian Aloia that Hector Cartagena and Michael would have our full pay reinstated. This was fantastic information, as he was considering accepting some of the financial support people and organizations from all over the country were offering to his family during this Christmas season. He was obviously happy to avoid bruising his pride by accepting anything he normally wouldnt because he was feeling the squeeze of going almost a month without a paycheck. Needless to say, he was relieved to decline the help with heartfelt thanks.
Exactly five hours later, the Bloomfield Township Attorney Brian Aloia again contacted attorney Cathy Elston at 7 pm. This time, Brian Aloia wrote an email saying, sorry for the miscommunication, but Hector Cartagena and Michael McCracken would not have their pay reinstated.
OPEN and PUBLIC administrative hearing dates are as follows: Hector Cartagena - Monday January 13 at 9 am, Mike McCracken - Tuesday January 14 at 9 am.
A few additional points - The current chief (Chief Goul) has fired 7 officers (including these men- assuming he gets his way) in less than 3 years. 5 of those 7 are veterans. He is targeting veterans!
Both Hector and Michael have completely unblemished careers in both law enforcement and the military until this occurred. They have never had so much as a verbal reprimand.

I lived in Bloomfield from 1962 to 2002. It was a great place for family. The changes from 1962 til 2000 or so were not many. But since 2000 the town has rapidly declined. (unless you are a progressive) Instead of being a neighbor of Newark - East Orange - Patterson etc it is now a part of that urban mess. I used to know most of the cops & fireman because they still lived in town. However I did not know this Chief Goul. I will try to get some info on him.
