Well my greater point in this is that when you go looking for trouble, you will generally find it. In my never to be humble opinion, this is defying/disrespecting law enforcement and that never ends so well. Human nature is what it is and LEOs ,being human beings will react the same as you would if one of your neighbors or employee or fill in the blanks defied you. Dont be stupid and don’t give them reason to jack you up!!

All agencies use the LEIN system (Law Enforcement Information Network). It’s country-wide. If you have a CPL (concealed pistol license, it will show up when they run your license number. So, if I were a CPL holder (darn, that tragic boating accident), I would also include the following:

“I have a registered S&W MP9. It is in the holster on my right hip”. And I would make darn sure to have my hands visible.

This looks like a good idea!

I agree with you 100%, sir. Law enforcement has the ability to wreck your day, but remember too that our Founding Fathers had the foresight to see a day when compelling someone to testify against themselves might be a real possibility, because it was something that happened often throughout history. The other side of that coin is that if you keep your nose clean, you have no reason to worry, but that doesn't mean that we should forget our rights.

This gentleman was providing a video to provoke a reaction, as was evidenced by his introduction. He was not, however, in the wrong to do what he did, and he provided a very compelling reason for doing so: if you have your window down, law enforcement officers can claim they smell alcohol on your breath or in your car and force you to take a sobriety test. It's your word against theirs and in an overwhelming majority of cases, law enforcements' word is going to stand up in court against yours. This is where they can wreck your day: he/she could be having a shitty day, could've dealt with a real jackwagon in the car in front of you, and because they simply don't like your face, they could make all the claims in the world, and you're now sitting in a municipal court fighting for your time, your money, and possibly your freedom.

Put yourself in a vehicle, windows up, your credentials visible outside, and in the presence of a dozen other LEOs, they have no probable cause to search you otherwise require you to pull off the road. This is a bit standoffish, but it's not illegal.

I would point out that these traffic stops are not just to get drunks off the highway and save lives, but also pick up those driving without drivers licenses and registration, people with outstanding warrants against them, stolen cars, etc.

if you check the results of these checkpoints, most citations appear to be drivers without licenses and registration. And many of them are illegal aliens.

Remember the highways are public, not private property. And the police are charged with keeping them safe for the public.

This crap might work in some places in Florida, but if you try it in some places I know of, they’ll bring out the drug sniffing dogs, the dogs will alert on your car, and drugs will be found in your car.

You know I agree that this guy is not breaking any laws or anything like that. I get all the illegal search and self incrimination arguments, however I do predict that somewhere somehow there’s going to be an incident that will result in some kind of court case. these things always do, so to correct the problem fed, state and local legislators will pass all kinds of asinine laws the will only further erode our rights. All because some guy decided that he didn’t need to roll his window down.

It’s a crappy situation that can only be made worse with provacation

Not true. Not ALWAYS. While it may seem normal and quite unobtrusive to us today to need “papers” to drive, the right to travel and move freely through the country has been eroded considerably over the decades.

Do you think you needed a registration or a license to ride a horse? How about drive a wagon? What is the difference?

Taxes to pay for the roads. That is the difference. Then “safety”.

So it has not ALWAYS been the case.

Slippery slope we are on here when we allow cops to pull people over for no reason at all other than see if they had anything to drink.

Untill the state legislatures in every state ban this sort of highway check, we’ll have to drive sober, which ain’t all bad...

What's funny is the Unintended Consequence:

They're going to totally destroy the value of restaurant liquor licenses everywhere. And that's a chunk of change.

The best way is to avoid driving or otherwise spending money anywhere on checkpoint nights (no revenues through purchases of anything). And always avoid using harmful drugs.

I realize how tempting it may be to do something like this, but I'd bet a nice crisp $100 bill that 8 out of ten times it will bring the driver a whole lotta misery.

Most cops don't play lil games. Some of the cards indicate, don't roll the window down unless the officer threatens to shatter it. At this point, he’z pissed.

You roll the window down, the cop says he detected the odor of marijuana or you were behaving in a suspicious manner. Now your standing along the roadway getting the 3rd degree or having your possessions rifled.

When your standing along the road, the officer “ for his safety” begins to grab your wrist to place cuffs on you until the investigation is complete....you pull your hand away ever so slightly because you happen to be the type that speaks with your hands. Now you have a nice cherry on your cheek and a broken front tooth when your melon bounces off the curb. Now the officer has charged you with felony resisting.

Fast forward a few months. After laying out bond, hiring a lawyer, a few hundred to get your vehicle out of impound lot, visit to the dentist....your in court. Will you win? Is the officer highly respected veteran and cozy with the judge for providing private security for his daughter's 21st birthday party?

Boom, you win. The judge dismisses your case, then what? You spend thousands more filing suit. Months later he prevails based on the fact he was acting on reasonable suspicion and you failed to comply by first playing games with officers that put their lives on the line by placing a dumb placard in the window/refusing to cooperate with the states anti-drunk driving efforts that save lives and protect the public, then by resisting/impeding an investigation.

Thank goodness I live in Texas...it is illegal for LE to setup DUI checkpoints. I think they are an abuse of power and grossly unconstitutional, but one things for damn sure, you'd better have the stomach for being roughed up or at the very least scrutinized with extreme prejudice. Cops have become hyper vigilant, everyone is a suspect.

In times past I have always called my friendly wrecker driver to get me and my car home in one piece! A 100.00 bill to get me home safe is CHEAP!

Another partial cover is to be puffing a ceegar, and crack your window no more than one inch. No freaking way the “smell of alcohol” reason should fly if the compartment is puffed up with smoke. This worked on a case in Ohio.
