The Justice Department on Saturday evening filed a notice that it will formally appeal a federal judge’s ruling halting President Trump’s immigration order.
Justice Department Attorney Michelle Bennett’s filing was made in response to a temporary nationwide restraining order issued Friday that halted Trump’s executive order banning citizens of seven countries from entering the United States.
The case now goes to the U.S. Court of Appeals for the Ninth Circuit.
Judge James Robart, who was appointed by former President George W. Bush in 2003, had ruled Friday in a case involving Washington and Minnesota that stopped Trump’s order immediately

The idea that a district court judge can issue a nationwide injunction reversing the President’s order on a question of national security is crazy. Let’s say the EO came out after 9/11, when no one knew who was attacking us. Surely the President’ decision cannot be reversed by a judge, not when we were on the precipice of war. If you accept that, you have to accept that in all circumstances, this has be viewed as committed to the Executive branch. The judiciary simply has no ability to make a judgment about national security, not like this. If Congress wants to circumscribe the President’s authority, that’s a different story. Surely at some point in the judicial process, someone will realize this. But it may have to go to the Supreme Court.

I think the question of standing is a stretch, and it will be interesting how an appeals court will deal with the conflicting interests of federal over state government. If the state argument were to stand then what happens to states that allow illegals to matriculate?
What was filed was not an appeal, but a notice of appeal. It is a one-pager stating the case, the name of the Appellant, the order appealed from, and the basis for appellate jurisdiction if other than a final order, signed by the attorney filing the appeal.

I understand the appeals court and even the supreme court rulings in this type situation will be a quick turn around
NOW they are saying what was filed was a notice to file an appeal.... If they can’t get it straight I sure can’t. Sometimes I wonder if their incompetence is because of stupidity and on purpose.

Don’t get all excited people, it was filed with the 9th Circuit. The 9th is the most activist, liberal circuit in the nation. I will be very surprised if they order a Stay.
