You’ve got it right. More to the point, allowing the enemy the power to dictate the terms of the fight transfers authority constitutionally held by the Executive branch, over to the Judiciary.
That’s what Trump is in essence doing by deferring to the courts every time one of his EO’s is struck down by a judge. And that transfer of authority is on its own unconstitutional, an abdication of the authority vested in the Executive branch by the U.S. Constitution.
It’s the same abdication of authority Congress performed on itself when it began to essentially defer tough risky decisions over to the judiciary, which it has been doing now for years. Thus we now have two branches of government running scared and deferring all “risky” decisions to the judiciary.
Calls by these branches of government for the Supreme Court to “intervene” and make decisions which rightfully belong to themselves are nothing but an abdication and transfer of Constitutional authority over to an unelected branch of government.
Congress is now, and has been for years, impotent. An Alinsky dream come true. The same voluntary abdication to the judiciary of its constitutionally-mandated authority to rule and make decisions and to have them enforced, is now taking place within the Executive branch.
Every important decision of the Trump administration is now being argued and decisioned by lawyers and Clinton and Obama appointee judges in the lower courts.
In the meantime, the time it takes to move these court cases through the system has provided a window of opportunity for our enemies to insert Muslim extremists into our country.
We have now lost two branches of government, branches which were essential to providing checks and balances to the consolidation of federal authority within any one branch. The founders knew well what the dangers were.
We are now being ruled by a completely corrupted and suborned judiciary. By appointees, and not by anyone whom the U.S. electorate voted for, who now have total authority to suspend both Executive branch and Congressional branch orders issued on immigration and national security.
Two of the three branches of government, the only two controlled by the voters, have now been effectively stripped of power and authority. We are left with the one which has never been or ever will be subject to the will of the people and is immune to elections and can hold power for years and years. Coincidence?
This is a frontal attack on the American people and U.S. Constitution.
Can you remember in 2015 when Obama unannounced seeded the schools in numerous cities and states with so-called “refugee children” who had serious health issues, without even consulting with the various states? The states went to court to stop the onslaught.
They were promptly spanked by the judges who told them immigration issues were solely the province of the President, guaranteed by the Constitution, so hands off and do what you are told!
Contrast those rulings with the one-eighty the judiciary has done since Trump’s election—suddenly the President has no authority to issue immigration bans and the states attorney generals and lower court judges now have standing to reverse Executive branch orders on immigration and national security.
This is a Constitutional crisis of immense proportions, effectively a cold coup d’etat.

More than 180 or we could do it until the wall is complete. How would they like that?
It can also be accomplished by strengthening the vetting process to be extraordinary in it’s detail. I do not believe he even needs an EO to do this.
These two burka wearing, Feral tyrants need to be arrested and thrown in jail. It’s time “judges” be required to run for office. They all have become politicians, make them be required to be elected by the American people.

The liberal politicians and elites don’t give a crap about who comes in the country...They only care about Trump eroding their “power”...Anything to go against Trump is their ONLY concern...
Their children are in protected private schools...They live in gated communities and have bodyguards protecting them and their families...

Another thing that bothers me is the fact that this executive order was important enough to be one of the first things Trump did upon taking office.
If it really is THIS IMPORTANT, he must fight more (e.g. ignore their ruling). If he’s willing to wait while it meanders through the courts, then it makes the issue look more like a symbolic one rather than one that is critical to our security.

It would seem there is another, shadow "congress" that represents the interests of the People Of Sodom; it is able to veto both the legislative and executive branches whenever it wills.
Time and again, when the people vote the wrong way, the Judges Of Sodom step in and tell the proper citizens "We don't think so".

I disagree that tourism should remain open. 100% shutoff for 90 days, or even 180. Cite the judicial contempt of the constitution and statutes in the order. Stop issuance of ALL visas for the entire duration. Rescind the rules for granting a visa, pending the creation of a new vetting system.
And then get on every medium available to excoriate and ridicule the federal judiciary for the fact that they cannot read the law, cannot understand its plain words, and are so beholden to partisan politics that they ignore their constitutional duty - to INTERPRET and not rewrite the laws.
I wouldn’t get too involved calling for impeachment (yet). First, whip the people into a lather by educating them on the supposed non-partisan judiciary’s misconduct. Let businesses get mad - but make sure they know where to aim their ire.
Disallow renewal of visas while in-country, meaning that if someone already has a visa that is to expire, they have to go home and reapply there for a new or extended visa. This includes H1B and any other job-related classifications. However, until the 180 day window passes, the names simply get added to a list to be processed FIFO (First-in-first-out).
Once Gorsuch is seated, take the case directly to the supreme court, extensively citing USSC precedent that states that the words of the EO are accepted prima facie as valid, and that the court has just about zero say in the conduct of visa processing and border control.
Keep up the barrage against the judiciary’s conduct, and rail against the democrats’ delight in preventing a republican president from doing exactly what the exalted zero did - have a gang of tweeters, including the tweeter in chief, ring that ugly bell every day or two. Make the media try to ignore the tweets, and make the dems defend their very political lives every damned day.

Time to close the visa processing departments for some routine ‘maintenance’. They all could probably use a good coat of slow drying paint applied by 4 or 5 of sloths. We should have them back at their desks in 7 or 8 months.
Why don’t conservative judges start doing this with the abortion issue. That would push it before the Supreme Court eventually.
Judge Theodore Chuang is another Barack Obama stooge and a democrat. Obama mentality is sweeping the democratic party.
It’s more likely that appeals court reverses. If it’s on the same grounds as the HI stay, that should put the ban back in place.
