There is no “right” to serve. The military exist to kill the enemy and break his toys. Full stop. It must be able to select those volunteers most able to do that. Sex deviants detract from the mission. Full stop.

They set the qualifications and if you meet them, you’re in. If not, that’s the luck of the draw.
The courts should not decide military policy. If the ACLU and others have an issue with it, they can take it up with the voters.

They don’t let people who have had concussions fly airplanes in the military. Why should they let people in the military who can’t deploy due to the 9- to 10-month recovery time from surgery and frequent medication updates?

Not if you’re mentally, emotionally, morally or physically unfit. If you are mentally or emotionally disturbed because of your natural gender or otherwise too stupid to know if you are male or female, you are unfit.
No one has a constitutional right to serve in the military. If there is a “Constitutional right to serve” then that covers any and all citizens including the aged and the paraplegic. As soon as it is a “Constitutional right” it gets loaded with all the legislated equal treatment laws. The Army would eventually be required to make battlefields wheelchair safe. There are many judges that would go along with every bit of that. In a Clinton presidency the DoJ wuld decline to defend against such lawsuits and they would become law.
