“The HOA fees almost doubled within a year and the lawyer signed contracts with certain contractors who were the only companies authorized to do any work on any home.”

Care to provide the name of the HOA so I can verify your info?

sorry to go off-topic... Sister-in-law taking care of elderly aunt who needed surgery... New doctor’s name is Dr. Fu. She was asked how to spell it - more than once. She finally just started responding “F U”. I told her I would’ve said “two letters, first one is “F”” We’ve been laughing all week.

In my state running a crack house is an actual crime. If it is not a crime in your state then have at it. Store all the junk cars on your yard you want. Just don’t let oil leak over on to my yard. If you have a proper backstop to keep your bullets in your own yard, shoot away. I would not make nor oppose others’ making noise complaints.

Do a case law search. You might be surprised. For example -

I don’t see how they are unconstitutional. They are contracts freely engaged in. I would not engage in any such. My property is my own and I have no rights to yours without a contract. If you want to contract away your property rights then that is your prerogative.

What I said is I would not buy into any such agreement and have no sympathy for any one who bets bitten by one he has signed on to. They made their beds, etc.

“I prefer my neighborhood to be free of basketball hoops on the street, cars up on blocks, purple houses and dead or overgrown lawns.”

The HOA where I live was disbanded some years back. Oddly enough, we still don’t have “basketball hoops on the street, cars up on blocks, purple houses and dead or overgrown lawns.”

As a bonus, we also don’t have the 5% nosiest neighbors trying to tell everyone else what trees they can plant, what color the house has to be, or when to remove holiday lights.

“By your lights, it’s OK for me to run a crackhouse out of it?”

Go ahead, don’t be surprised when you are raided because a neighbor dropped a dime on you and you lose your property and go to jail.

“Or store junk cars in the front yard?”

Again, do your thing.
Don’t be surprised when the county cites you, fines you and makes you pay to remove the junk vehicles.
You either remove them or pay for plates and insurance on each vehicle.

“Take target practice in the backyard with my 7.62?”

My closest neighbor and I frequently target practice in her back yard. She has a natural backstop perfect for an afternoon of firearm tomfoolery.

The neighbor behind me built a great firing range. Sometimes it sounds like a lively skirmish taking place.

“Cool!”

Yes, freedom is very cool.

You ain’t kidding.

Back when I was reporting for newspapers in VA, NC, I got involved in a couple homeowner’s association brouhahas — they definitely showed people at their least neighborly. And of course, I’d get grief just for reporting the plain facts of what was going on.

Well, if the facts make you look like a power-hungry little tinpot tyrant, don’t blame me.

Actually, the worst homeowners association story I heard of came from a colleague, who told me about a harmless little old lady who was harassed into moving because the neighbors didn’t like the new color of her shutters.

Sheesh!

I have owned 45 houses since 1966. I will NEVER own a property that has a ‘Home Owner’s Association’ or Code, Covenants & Restrictions.

I live rural & will continue to do so until I die there.

They usually only apply to ‘developments’ & are a more recent part of the real estate landscape. I lived in So Cal in what was certainly a development, but that house was built in 1953, and there was no HOA.

I have lived rural since 1993 & there are no HOA’s out here. County has code violations, but with he recession, the code enforcement officer was cut out of the budget.

I take it you would like living in an orderly directed community where your decisions about your property are made by the Authorities. That’s fine by me but I don’t like the concept, myself.

HOA’s are very well-known for attracting control freaks exhibiting nazi-like behavior, you have been well advised to avoid them. I’ve got numerous old friends who live in an historic district on the edge of a state university campus here in NC, it was so fun going house to house for birthday parties and such, I thought I wanted to live there. Great looking old neighborhood too, from late 19th c through Craftsman style and on into Cape Cods that were built on the few remaining vacant lots after WWII. Started looking around then the stories about the “hysterical commission” started to seep out from my friends, many of whom are somewhat leftist so it surprised me that they hated them so. Seems one particular control freak lesbian would sneak around in people’s backyards with a camera, even climbing fences to trespass, taking photos of “infractions” such as incorrect paint color, incorrect outdoor furniture, banned things such as inoperable motor vehicles (under a tarp behind a privacy fence, mind you, so not visible to anyone outside the backyard, even incorrect exterior paint color scheme that was just off slightly by a shade. Needless to say, I didn’t buy a house there. I’ve since found out that they have tree police who will fine you if you trim your crepe myrtles “incorrectly” and will force you to replace a tree cut down even if it was dead. Nazis, as I said.

What towns were from your examples of false equivalencies at?

HOA by default are authoritarian. I had hits or misses where I bought from that contained HOAs.

One neighborhood went from reasonable to totalitarian very quickly. Had to pay an extra $185 a year because of some pool/playground that never materialized because I lived on a certain street. The rest of the community targeted our street and the HOA was very friendly with the local government. Did the sensible thing and moved.

http://www.ccppoa.com/CCPPOA-—Property-Manager.html

Top right hand corner where I used to live was the only street that was ordered to pay this “fee”.

My guess is that you are a on a council of a HOA. That is fine, I understand HOAs and Stepford way of life mentality, but also understand the right to do what the heck you want on your own property as well.
