Yes, if McCabe is indicted and convicted while in government service, he can lose his pension.
What most people do not realize is that if the conviction is for an official action that was criminal, he can lose his pension even if he has retired. Yes, I know that is unlikely to happen because so many people will label it “cruel” and “punishing his family”, but doing so will give pause to others in government service if it was done.
