The Migratory Bird Treaty Act has already been so interpreted.
I have a client whose home is near where a flock of migratory birds covered by the treaty decided to nest. He got a letter from the State Department of Land and Natural Resources saying that if his cat disturbed any of the nesting birds or their offspring, he would be liable for violating of the MBTA.
He basically said “screw you,” and as of yet the State hasn’t had the guts to do anything further, although I think his cat does run the risk of being trapped and destroyed.
Mind you, these birds aren’t endangered or anything else (frankly, they are a nuisance), but they are covered by the Treaty and so they are protected.
These avians will learn to migrate elsewhere.

My experience working around and under them is not just the whoosh whoosh, but a low level grinding noise that is quite irritating.

Wonder if the author would support the lifting of the laws banning people from hunting robins [used to be as popular as dove hunting], owning migratory bird feathers to use as decorations on hats, owning song birds as pets, artists taking birds for study skins, etc.... because the numbers of birds that could be affected would be insignificant relative to any one of the bird dangers he listed?
I suspect the author would freak out at the thought of deregulating things for the ‘little guy.’

If accidentally killing birds was a crime, the liberal windmill farms would be out of business. They kill thousands and thousands every year.
