Another felony for the books, because now just getting into your car is enough to get you charged with impaired driving Been true for about twenty years. You can be in the back seat and get DWI. If you have the keys you have potential control of the vehicle. If you are going to sleep in off in your car the keys need to be outside of the car.
The nanny state will always get tougher and more unreasonable. Laws do not have to make sense. They just have to serve those in charge.

Actually, just being in the car implies “Care and Control”.
Happened to an associate of mine. The keys were on top of the passenger’s side rear tire, he was asleep in the back of his 2-door.
3 month suspension, 6 months with an ignition interlock device, over $7000 in fees and fines.
Really.
