So called “Judge Napolitano” is full of himself and his words on Fox are getting tiresome. We are being invaded by illegals, they are not citizens and don’t deserve due process. Build the wall and don’t let them in.

This is one component of the the Lopez Obrador scheme to ejyliminate 5the border. DJT’s remarks seem to be suggesting that such events would trigger a declaration of a national emergency on the border.

This already is existing law and has previously been tested in the courts. It is known as an “Expedited removal” and US immigration officers have been processing illegal entrants this way for years. Another way to quickly remove these illegal alien invaders is by simply excluding them from entering the US and is a common practice at US ports of entry and international airports. Many aliens were excluded from the US when Ellis Island was being utilized to screen large groups of aliens coming from Europe. So, nothing new here. We just need to apply the existing laws.

And as for escorting them to the border and simply letting them return to Mexico has also been done for years. It’s known as a “Voluntary return” and does not count as a deportation/ removal from the US.

It seems to me that I read somewhere that prospective immigrants at ports of entry like Ellis Island were often returned to country of origin without any legal action other than an administrative decision on the part of immigration officials.

At that point, they were not landed immigrants. The right of a sovereign nation to refuse entry is globally recognized by all but the European Brussels bureaucrats. Same as your right to bar entry to your home to anyone who rings your door bell.

The issue is not whether or not they can be deported. The issue is -— Do they deserve a trail first?

We are now in a bit of a conundrum since the SCOTUS just ruled administrative judges to be unconstitutional.

Before the ruling we could have possibly made many ICE agents administrative judges with extremely limited powers who were only allowed to rule on the issue of deportation for people coming over the border.

I’d love to go back in time and slap some of those Constitutional authors. I would say, add English as official language. No illegal immigrant will get anything from the United States government or any private organization. Christianity is the official religion and I’d tell Thomas Jefferson to shut up and do it.

Probably not. Gitmo case allowed for foreigners to get trials so I would imagine that started a precedent.

The very first line of the US
constitution states very clearly
who the “people” are. It does not
refer to people of the world, but
only those that are US citizens.

“We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.

And the 14th amend has been misinterpreted
as ALL persons present are entitled to
due process.
“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

“Person” in the misrepresentation has been
argued to mean ANY person in the US.

Not really surprised. Judge Nap is a solid Libertarian, an idealist. He sees things via his L filter.

Sorry, but the Constitution is a pact with US Citizens. Period.

Illegally Stepping foot onto US soil does NOT give you due process rights. We cannot survive with this type of utterly buffoonish nonsense. We are being invaded.

Mexico is hostile to the United States and we are under attack. Send the US military to the border and stop this invasion with force.

Yes, they apply to everyone, but it is not the U.S. government and U.S. taxpayers who are responsible for ensuring them for anyone who is not a U.S. citizen.

The fact is that most other countries in the world do not recognize those God-given rights. It is not our job to force them. That is what has gotten us into so many losing wars, only to see the primitive societies go right back to their tyrannies and despise us in return.

Inviting those same people here with no vetting or pre-conditions is even stupider than going to their countries to try to fight to protect them from their abusive governments.
