It means the entire panel of 9th Circuit judges would rule on it rather than the three judge panel that just issued the ruling.

While that is true for other U.S. Circuit Courts of Appeal, it does not apply to the 9th Circuit. There are so many judges in the 9th Circuit, Congress has provided that an en banc review panel consist of the Chief Judge of the Circuit and 10 other randomly selected judges.

Yes and no.

When written, it was an absolute prohibition against Federal regulation or criminalization of the keeping or bearing of arms. It still is that.

It did not apply to the states. At all. Which is why it was originally Constitutional for the states to regulate and/or criminalize the keeping and/or bearing of arms (to the extent the states’ respective Constitutions may have permitted it.)

However, the 14th Amendment was passed in response to the Black Codes. One of the things the Black Codes did was to criminalize the keeping and bearing arms by freed slaves. Once that Amendment was ratified, everything changed:

“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

In the context of the fact that the purpose of the 14th Amendment was to make the Black Codes Unconstitutional, the meaning of those words is not a debatable point.

Yes, I agree. The full court may strike this down. In recent years the court has had some surprises for us.

Generally it’s the same old court.

I note how Republicans have just blocked a very good man to that court.

What a wasteland our Senate is.
