The FBI has policies against their own agents being recorded.

If you wish to avoid an FBI interview, merely tell them it will be recorded. They will refuse to conduct the interview.

I had it happen to me. I had some information that I wished to give the FBI shortly after 9/11. I said I wanted to record the interview. They told me if I insisted on recording, there would be no interview.

Lets hope so on all counts. Mueller and company and the Justice Dept and FBI have to be terrified that it will all be made public if there is information that implicates them.

If shenanigans did indeed happen, we need to know about it. The future of this country depends on it. And, no “what you don't know wont hurt you” doesn't apply here. An open government is a must when the resources of that same government are illegally used against a citizen.

That's exactly right, P.O.E. I do worry whether Mr. Donald J. Trump fully realizes the peril of the Martha Stewart trap, in which a politically motivated prosecutor simply makes up imaginary crimes that then act as a gigantic tar baby in the courts and in the arena of public opinion. The President's current attorney, Rudolph Giuliani, does seem to be on the ball about this matter, so I'm optimistic that this particular witch-hunt tactic will fall flat on its face in a stinking puddle of corruption.

If Trump says "uh" the first time then says "um" the second, they'll proclaim "Trump changes his testimony".

Not necessarily true. They wanted to imprison her and they would have just found something else. They NEEDED her to get the blame for 'insider trading' to keep the public's attention away from the fact that THEY were doing ILLEGAL INSIDER TRADING. After they convicted her, they changed the laws so that politicians can do INSIDER TRADING LEGALLY. Not you, not anyone else, but THEY CAN.

The Fifth Amendment states: “nor shall any person…be compelled in any criminal case to be a witness against himself.”

Seems to me the first step into a perjury trap is taking an oath that what one has stated or will state is true. A case against someone for perjury will use the fact of taking such an oath against them, which seems to me, turns that someone into a witness against himself.

What happens if someone refuses to take an oath to “tell the truth, the whole truth, and nothing but the truth” on the grounds that doing so could be used in a criminal case against him, resulting in him “to be a witness against himself”, even if he’s telling the truth so far as he knows?

I believe under some circumstances one can be held in contempt for not taking such an oath but that seems like compelling one to be a witness against oneself if a charge of perjury is brought.

This asshat is of course foremost an anti trumper. All of his articles contain at least one Trump slam, like the one above. He’s basically a pompous jerk who really shows no support for Trump. However, hid disdain seems more for Mueller so we accept him. I’m not holding my breath when it comes to supporters by our president.

The real trap is that even though the President would tell the whole truth, they would find somebody or somebodies to say no that is not true. Of course Mueller would believe these “witnesses” and prosecute. And it is a guilty until proven innocent situation. Also the interview is not recorded. Mueller could state that the President said XYZ when the President said ABC.

Seems to me there is only one to prove this, Bring in 10 High pollutant Journolists, Put them under Oath and have 3 investigators from the FBI question them separately.

I would bet my Last Nickel EVERY ONE would be Charged with Perjury.

You are right. Both halves are excellent. I really love the way your words can be used against you in ways you never imagined, even if you are 100% innocent.

Look ad Flynn. What if he had refused to testify to those guys and just referred them to his lawyer? You can’t use a guys words against him unless you have his words.

Just need to explain what sworn testimony is to Mueller. Tell him to picture it as he pictures the Constitution, fluid and dynamic. Changing along with the need for change.

That about sums it up; Flynn would be totally free and clear.

This is the reason why the first thing out of a cop's mouth after a traffic stop is: "Do you know why I pulled you over?"

He's intentionally and deceptively seeking to prompt you into willingly incriminating yourself by admitting or confessing to a "crime": "I was going over the speed limit; I was going too fast; I accidentally ran a red light; I missed seeing the stop sign"; etc.

By simply answering his seemingly innocuous question he has intentionally tricked you into incriminating yourself and confessing to a "crime". Because by answering you have incriminated yourself by your own admission and "confession of guilt". Because:

"ANYTHING Y O U SAY C A N AND W I L L BE USED A G A I N S T Y O U IN A COURT OF LAW".

Of course the policeman NEVER TELLS YOU THIS B E F O R E HE ASKS YOU THE QUESTION "do YOU know WHY I pulled YOU over?"

*The correct and only answer you should ever give to the above question to avoid self incriminating is:

"I honestly have no idea officer; I guess YOU WILL HAVE TO TELL ME."

*Say absolutely nothing more than this to his question, period, full stop.

Therefore the accusation of a "crime" is his, not yours and there is nothing in your statement to the police officer that he can use to incriminate you with in court.

And whatever you do, don't try to apologize, plead innocence, make excuses or "plea for mercy"; unless you have a genuine emergency: wife's having a baby, serious medical issue needing immediate attention etc... Because in his mind he has already convicted you of a perceived "crime".

Be professional, and courteous, keep both hands on the wheel and comply with his request to see your license and registration, that's it.
