Well, if we are going to COMPLETELY ignore the Separation of Powers, it only makes sense that the Senate should just write a Senate Rule that states that the Judges ruling is immaterial.

Where do the Democrats find these idiots. Does he not know the Constitution well enough to know that the courts cannot interfere with a senate in the course of performing its constitutionally mandated function?

The IRONY here is that Majority Leader Senator Harry Reid did the ‘nuclear option’ of simple majority versus 60 vote minimum especially for the DC Court of Appeals. Now Idiot Merkley is appealing to what may very well be one of the judges that Obama / Reid got in place through that effort. Even the most idiot Judge there will likely tell him that this is interference with the legitimate powers of a separate and equal branch and thus out of the jurisdiction of that court. If not, then it likely will be a 3 Judge referral and then a total ‘en banc’ decision before up it goes to the Supremes and we will see if it is 8 or 9 judges there and what happens then.

A lower court created by Congress has zero legal authority to stop Congress doing its lawful job.

Hasn’t stopped them since Trump became President. This has me worried- she could do it, then what, wait for a decision from the supreme court to over rule her? That could take months.

Scheduled for next Tuesday. Then it will be rendered moot.

A federal court can’t tell the Senate how to manage its affairs - the separation of powers.

But this is what Democrats do when they lose a vote - run to the courts to undo the decision of the majority.

Jeff Merkeley far more out of the mainstream than Judge Kavanaugh.
