Well, they tried to before, when they had a supermajority under FDR. The political fallout was terrible, and the effort failed. But that was simply “packing” the court for nakedly political reasons. (”Luckily” for FDR, everyone “retired” within the next year.) If Ginsberg is unable to vote, there’s a much better case for replacing her, even if she hasn’t resigned officially.

She has the spite but not the spit. That dried-up old prune will be sitting at the bench one day and drop off to sleep for eternity. And Barrett? Ha! It will be impossible for the rats to accuse her of being a sexual predator, so they’ll have to concoct some other false allegation. Maybe she stuck her tongue out at her teacher in third grade!

We all have prefererences but given what he has done so far I’ll support whoever POTUS selects (and fights to have confirmed!)

I don’t know about that.. her most recent interview was pretty rough. She speaks very slowly and has to pause often. She sounds to me like she’s fading fast.

I saw an interview with her a couple of weeks ago (probably the same one you mentioned.) She appeared very frail, with her head slumped down during most of the interview. She was articulate, but as you said, she spoke slowly and very deliberately.

I remember that Federalist Society talk she gave. She was outstanding. I meant only to watch a few minutes of it to get the gist of where she’s coming from and who she is, but wound up watching the entire thing because she just drew me in. She is impressive in her knowledge of the Constitution and her logic. She will be a tremendous asset to the SC. It will be a loss for the court she will leave.

No, they really had to go to the mat for two reasons, as I see it, because they wanted a moderate, one who would turn liberal, to replace a moderate, and also, because of what he testified to in the hearings about the Constitutionality of military tribunals for treasonist acts. They brought out the letter AFTER he made that statement, the day after, actually. That’s when it was ratcheted up.

Should Ginsburg’s seat become open while President Trump is in office, the confirmation battle to replace her will make the Kavanaugh hearings look like a pillow fight will, IMHO, be brief.
After this fiasco, IMHO the Senate Rules will change at the start of 2019.

I trust that the Republicans will hold the Senate handily, with a functional majority (at least) rather than the effective tie we just saw fought out. And the first thing I think the Republican majority will do is make sure that the Majority Leader can simply call the question, with or without action by the Judiciary Committee, on at most a week’s notice.

And the minority will know that he will use that at the first sign of abuse of process in the committee. Without that assurance, who would dare to go through what Kavanaugh was subjected to?

A century ago, SCOTUS nominees were confirmed by the senate in short order. The Judiciary Committee will be on a very short leash after Kavanaugh.
