I don’t believe that leftists uniformly oppose the death penalty. Believe me, if left gets power, they will use the death penalty just like all other authoritarian regimes.

It’s not that people committing heinous crimes do not deserve the death penalty. Government is imperfect and therefore cannot be trusted with THE ultimate and irrevocable penalty. So, the Washington State SC is simply ruling that the State cannot provide the highest standard of due process that must be accorded to an individual facing the death penalty. Unlike less serious crimes, there can’t be any mistakes here.

Our justice system is seriously flawed; we have seen this on full and flagrant display at the FBI and DOJ. Prosecutors have too much power and are often corrupt. Government employees are rarely fired because of civil service protection which enables cover-ups and secrecy.

I guess it might be arbitrary if someone committed a crime worthy of a death penalty & racially if someone was a certain racial group...ANY racial group. Now,they may have to turn a few loose because of prison overcrowding which these Dummies created.

Since not all speeders are ticketed, doesn’t that make ALL speed limits within the state “unconstitutional?”

Since not all robbers are caught and punished, doesn’t make ALL laws against robbery “unconstitutional?”

I mean, if “arbitrary” enforcement is grounds for a law to be unconstitutional, then every damn law on the books in Washington State is UNCONSTITUTIONAL!

Leftards do not see the contradictions in being opposed to the death penalty for convicted murderers and in favor of the murders of innocent human lives in the womb.

Ironic that the left wanted to crucify Kavanaugh over some unfounded (and not terribly important) allegations from 36 years ago. Yet, every chance they get, the Left fights tooth and nail to prevent rapists, murderers and pedophiles from paying for their crimes.

Here's an example execution case from Texas Death Row; Erick Daniel Davila

Summary of Incident:
On April 26, 2008, the subject and codefendant drove to a birthday party where the codefendant dropped off the subject. The subject went to the back side of the car, grabbed a model SKSS (7.62mm caliber) semiautomatic rifle out of the trunk and walked toward the apartment. Once the subject got to the apartment where the party was located, he went inside and opened fire. The shots fired resulted in the death of an adult black female and a five year old black female. Several other victims at the birthday party were injured.

OK, now that you know what he did, check out his last statement:

Yes, I would like to say nephew it burns huh. You know I might have lost the fight but I’m still a soldier. I still love you all. To my supporters and family y’all hold it down. Ten Toes down right. That’s all.

While I don’t agree with this ruling, it costs well over million $$ to try a death penalty case in Washington state. Those cost are paid by the local county government where the trial is held. It may be un-written but that is a primary driver in the Prosecutor’s decision.

The left doesn’t have a problem with beyond-any-doubt proven guilt. They then bring up the REASONS someone would do what they did as “beyond their control.”

That statistic is meaningless unless the question "compared to what?" is asked. (Thanks, Thomas Sowell.)

What does it cost to house an inmate in maximum security prison for his entire life (assuming a young convict), pay his food, medical, miscellaneous and LEGAL expenses while he goes through parole hearings or appeals, and the very real possibility of harming or taking the lives of other inmates who are NOT violent offenders?

Could be 45 years of these expenses.

According to the article, prosecutors do not show racial bias in seeking the death penalty. The unequal application of the death penalty is being created by the inherent racism of the jurors. Based on the UW analysis, if you are a minority, you are four times more likely to receive the death penalty from a jury than if you are white.

Since Washington state is 77% white, you cannot possibly expect to change the inherent bias/prejudice of the general population. No, your only choice is to take away the possibility of the death sentence being inappropriately imposed by them in the first place.

BTW, I am actually in favor of life imprisonment without parole IF done properly. For me, done properly would be permanent solitary confinement under very harsh conditions. How harsh? You’ll know they are harsh enough when convicts begin petitioning the court for resentencing so they can be executed.

Ugh....compared to a non death penalty case. Washington state law requires certified DP attorneys that are assisted by regular court appointed defense attorneys, plus investigators, and other staff. It costs the state $37,000/year to house hard core prisoners
