Judge Napolitano is really sounding like a leftist these last few months. It sickens me to listen to him lately. He probably wants POTUS to pick him for the AG position. NO.

I think Napolitano is 100% correct on this.

It's a fascinating issue that revolves around the clear Constitutional requirement for the U.S. Attorney General to be confirmed by the Senate. The Federal statute regarding succession and the appointment of cabinet members in "acting" roles is almost certainly unconstitutional on this point.

What's interesting is that nobody outside the Senate really has the legal standing to challenge the appointment unless and until Whitaker starts to perform any "official" functions as AG. I suspect he will never perform any such functions at all. He probably won't hire or fire any senior DOJ officials, will not sign off on any Federal civil or criminal case as AG, etc.

Let's see how this plays out. I have an interesting theory about what this appointment was all about:

Whitaker was probably put there just to cut Rosenstein out of two processes: (1) oversight of the Mueller investigation; and (2) the DOJ stonewalling of Congressional demands for documents related to the illicit FISA warrants and the CIA/FBI interference in the 2016 election.

Napalitano is wrong in saying saying that Trump's new acting AG is not legally qualified to be acting AG because his current position is not one that requires confirmation by the Senate. He is referring to USC 3345. He stops at section (a)(2) which says :

(2) notwithstanding paragraph (1), the President (and only the President) may direct a person who serves in an office for which appointment is required to be made by the President, by and with the advice and consent of the Senate, to perform the functions and duties of the vacant office temporarily in an acting capacity subject to the time limitations of section 3346; OR

He fails to read on to section (a)(3) which clearly states that he can appoint him:

3) notwithstanding paragraph (1), the President (and only the President) may direct an officer or employee of such Executive agency to perform the functions and duties of the vacant office temporarily in an acting capacity, subject to the time limitations of section 3346, if—

(A) during the 365-day period preceding the date of death, resignation, or beginning of inability to serve of the applicable officer, the officer or employee served in a position in such agency for not less than 90 days; and

(B) the rate of pay for the position described under subparagraph (A) is equal to or greater than the minimum rate of pay payable for a position at GS–15 of the General Schedule.

Under this section he doesn't have to be in a position that requires Senate approval.He meets the conditions required in this section
