There is a difference between an assault and a battery. An assault does not require contact, only the threat of contact. But the lib probably didn't know that, which gave the cops an excuse to ignore his obvious ass covering BS, and send him on his way empty-handed.

Im not sure, but I think pulling a gun on someone and putting it in their face is a crime. But I could be wrong................... In Florida, it's called "brandishing," and it's enough to get you in deep yogurt, even WITHOUT any verbal threat.

According to the police report, surveillance video confirms Pierce's story that he did not put his hands on Phillips. That absolutely does not matter in Kentucky.
Brandishing a firearm in the manner documented by the video is either "First Degree Assault" or "Wanton Endangerment" according to Kentucky State Law. No physical contact or injury is required for conviction. Either charge is considered a felony.
With any competent prosecution, Pierce will be a felon, jailed for 1-5 years. Probably out on probation after the first year.
