These states are completely free to make sure their lunches meet higher standards, they have no standing for this suit as I can see it. They are minimal standards not maximums, nothing is there to prevent the states from setting their own standards above the federal ones.
Is there anything in the new standards that prohibits these states from setting a higher standard for their schools?
well guess what, DC and other states? Minimum standards are minimum standards. If you’d like to increase that standard at your own cost, knock yourselves out. But if you’re going to take the salt shaker away, take it away from those who are salt-sensitive, not everyone.
