Right. Would that open up the ability to sue the government? I was thinking specifically of Gen.Flynn who was basically bankrupted.

I agree 100%.

I believe that a lot of POTUS Trump's tweets are designed to keep pressure on Horowitz and prevent a whitewash.

I also believe that Sen. Lindsey Graham is sending a message to Horowitz. The Senate already has the information...don't attempt a whitewash.

I don't know why Sen. Graham changed, but I sure like the new Sen. Graham much better than the old Sen. Graham.

Just my humble opinion.

I feel the same way about Graham. His switch surprised me. And Jeff Session had me fooled. I liked him, thought of him as one of the few politicians I could trust, and then he turned out to be a Deep State plant used in case somebody such as Trump might win.

The Fisa court judges are the Dems firewall and their now years long silence has been deafening. How can any of the criminal Democrats be charged with crimes if the Fisa judges don’t even hold them accountable? Politically, they can’t. It’s that simple. So Graham will run his mouth and Democrat criminality becomes a political “matter” for 2020.

If Comey thought he faced legal jeopardy he would not be running his mouth 24/7/365. Obama era Democrat crimes are a political “matter” now to be decided in the 2020 election and everybody inside the beltway understands that. The sooner Main Street understands the fix is in the better.

There is no such thing as an illegal investigation.

Plus, the ostensible targets of the "formal" process were never charged. Carter Page, etc.

Prosecutors and investigators operate at what I view as the "fringe" of law - they have immunities, in some cases absolute immunity. This is why it is so important to only allow people with integrity into positions of power, there is scant (legal) remedy against the rogue.

For purposes of a S: 1983 malicious prosecution claim, the elements under federal law include: (1) prosecution for a criminal offense; (2) instigated without probable cause; (3) with malice; (4) under a valid warrant, accusation or summons; (5) which has terminated favorably to the plaintiff; and (6) has damaged the plaintiff.

For Flynn, a couple of those elements are problematic, but in particular, we have yet to reach "termination" of the prosecution.

It is up to the wrongly accused plaintiff to make the malicious prosecution claim in the first place. The Waco Bikers cases include a number of federal malicious prosecution claims. Very tough cases to make stick, the courts are protective. The system is biased against the public.

Joe DiGenova has a different take on the FISA abuse and he is well connected:

Graham is running for re-election.
He learned the McCain two-step from the master.
Sound like a conservative, then once re-elected, act like an amnesty whore.

There is no “new” Flimsey Grahamnesty, he’s playing the voters for fools.

He will be supporting another push for amnesty as soon as he is re-elected and will tell you that you voted for amnesty when you voted for him.

he’s [Graham] playing the voters for fools.

***************

That’s what most Republican politicians routinely do. Unfortunately, it works for them. We have to start voting on the basis of RESULTS, not empty words and rhetoric.

My personal preference would be to replace our support for the GOP with a new party that represents conservative interests instead of special interests.
