I don’t know how Texas is. but in my neck of the woods (a rust-belt state), I believe that defense would work. i would not expect her to get her job back.
The best she could hope for would be a deal: Keep your pension. Drop the lawsuit.
Yep, they own our school system.
In certain areas of the nation, there are very few citizens attending edifices built to the gods of diversity, (read that reconquista).
I was considering bringing my Thai Niece to live with us in America and attend HS, she is in advance studies in Thailand. However, I discovered I would have to pay for her education, it does not matter that I am a homeowner property taxpayer.
So again illegals are forced on the system at our expense while those that try to legally work the system are punished.

It depends upon how aggressive her lawyers are. Public education entities are also bastions of free speech. I've been in her shoes against a Texas ISD and gave them a pounding.
Wouldn't you love to see the Fort Worth Independent School Board of Trustee's faces if that happened?
Sadly, Ft. Worth has gone the way of liberal Dallas.
I’m in the mid-cities. Ft. Worth actually went that way before Dallas did. Dallas was still reasonably sane when Ft. Worth had Jim Wright and the liberal Star-Telegram newspaper. Now both have gone to hell. We moved out of Dallas about 10 years ago just to escape the increasingly leftwing and (inevitably) corrupt and incompetent city government.
We left Dallas during the white flight in the ‘70s when I wasn’t going to be allowed to attend the “white” school four houses away due to the busing.
Not quite yet. The Dallas DA stated not long ago that he was no longer going to prosecute petty thefts under $750. At least Fort Worth hasn't gone that far over the edge - yet. However, Fort Worth ISD has its problems.
Anyone her that didn’t see that coming?
One of the biggest mistakes we conservatives as a group make is not taking the left to task in our courts for their discrimination against actual citizens in favor of certain outsiders. They need held to standards of common sense and decency that favors the USA.
