The legal system in this country really sucks. Military and civilian.
We’ll never see the day when one of these prosecutors gets their just deserts because the people have been turned into sheep.
I can tell you from the prospective of a retired Army Officer who issued various punishments during my career that the judge risks having this sentence overturned as excessive punishment. This is a crime that could have been addressed with a reprimand, official or unofficial or something along those lines. Jail time for taking this photo is absurd and I hope President Trump will now move forward on a pardon full and complete. I would have called him in my office and read him the riot act or even given him all copied of a letter of reprimand which he could have done with as he pleased.

First, an E-6 cannot serve beyond 20 years, so he would not be eligible to reenlist.
Second, he will receive a “Special Performance Evaluation” upon his reduction in rate to E-6, and due to being convicted at a Court Martial. This “eval” will characterize his performance as “significant problems” and have a retention recommendation of “not recommended”, making him ineligible to reenlist.
Third, I doubt Chief Gallagher has any desire to serve in the USN at this point, though he may seek work as a “contractor”, where he will make far more money.

When I was active duty the senior NCOs would have photo albums full of pictures of dead enemy soldiers, many in extremely bad taste, and they weren’t for intel purposes. Many, many people had these albums. I always thought it was their way of coping with the grisly hell they lived in. They embraced it, rather than shrank from it. They would proudly show off the pictures and we had a lot of discussions about what the story was behind the photos. I always thought that was their form of therapy. You are always better talking it out rather than trying to stuff it away.
That's what courts martial are about.The 'panel",which acts as a jury,consists of uniformed members superior in rank to the accused...sometimes officers only,sometimes officers and enlisted.
I guess the jury is all military which I feel is fair.
I would feel the same as you do if it was military people like my father and his brothers served with. Of course, I doubt that he would have been brought to trial by people who were in war back then.
Agreed. Article 15 with Letter of Reprimand would have been appropriate.
Even if I had read an Art 15 to him and, I would have then put in a drawer in my desk never to see daylight again. I would have gotten his attention and would not have ended his career as a senior NCO.
So true. The punishment for taking a pic with a corpse should be the superior officer walking over and saying “cut it out”
