Under section 564 of the federal FDA Act, the Commissioner may allow unapproved medical products or unapproved uses of approved medical products in an emergency to diagnose, treat, or prevent serious or life-threatening diseases or conditions caused by Chemical, Biological, Radiological & Nuclear (CBRN) threat agents when there are no adequate, approved, and available alternatives. I have no doubt that if that legislation were not enough, an emergency order from President Trump or new legislation could quickly be passed to authorize a COVID 19 vaccine to be administered.

Not understanding what you are getting at. I never said we did ever approve any medication without lengthy years long trials.

My whole point was that Israel (and many if not all other Nations) can if they choose to do so approve new medications in a fraction of the time it takes here.

As the old English proverb goes, "necessity knows no law." Emergency powers by their nature are intended to dispense with ordinary legal requirements, to play fast and loose with the law, so to speak.

Go to the FDA webpage and you will find current emergency use authorizations for nine viruses and other medical conditions, including for emergency use of COVID-19 test kits.

In addition, broad Presidential emergency powers have little check except for procedural requirements in the National Emergencies Act. And under 21 U.S.C. §360bbb-3 (2004), the Secretary of HHS may authorize the use of an unapproved drug, device, or biological product, or authorize an unapproved use of an approved drug, device, or biological product.

If the COVID-19 epidemic gets bad enough, the public will clamor for access to experimental vaccines and drugs that have passed initial safety trials and will accept the risk of suffering other, unrecognized harms.
