The “jogger’s” older brother has been in prison, and currently is in jail awaiting felony prosecution. He has a cousin who also is in trouble with the law.
The fact that you use this as a part of your argument indicates just how weak you KNOW your argument is.
You should be embarrassed.
You are wrong. You do not have to see a felony with your own eyes in order to have probable cause. If that were the standard, the police couldn’t arrest anybody because they typically get called to the scene of the crime. So in another words, if a bank robbery took place, the cops couldn’t pull the bank robbers over since they didn’t actually witness the bank robbery. The Georgia statute specifically says the person can make a citizens arrest if they see a felony or it’s within their knowledge.
How is it premeditated if their intention was to arrest him? Or detain him? CLEARLY their intention wasn’t to shoot him for fleeing.
Except a video.
Seems completely irrelevant to the crime.
Does Georgia have the death penalty for siblings of criminals? Was he convicted? That’s just an arraignment.

Anyone who has a third cousin twice removed in prison is Guilty!

Even if that were true, it would have zero implication on what happened. The father and son had no right to what they did.
I saw the video. I might not elect the wisest course of action when someone waves a shotgun in my face. The perps need to serve time for this.

If Cortez Arbery, 25, is determined to be an armed career criminal, he will serve at least 15 years in prison. He was in possession of stolen .38-caliber pistol after having been previously convicted of three felony drug offenses, according to the U.S. Attorney's Office for the Southern District of Georgia. Arbery's guilty plea was the latest of several federal prosecutions cracking down on gun, drug and violent crime in the Brunswick area."

The defendant had also been charged with one count of attempted murder, two counts of using a fire arm during a felony, and one count of discharging a firearm causing injury.
We the jury, first all found him guilty. Then the discussion of which level of homicide to find him guilty.
The 400 lb lady sitting next to me in the jury room wanted to charge 1st degree. Her thinking was that the mere possession of a fire arm proved premeditation.
She didn't like it much when three of us guys on the jury told her to stop being stupid. We were not kind.
Bottom line, we convicted him of 2nd degree murder, two counts of using a fire arm during a felony, and one count of discharging of a fire arm causing injury.
This happened 20 years ago. The man got a life sentence as a career criminal. I check about once a year to see if he's still locked up. Last check, he was.
It doesn't matter if the son knew him. If he was helping his father with his vendetta, he is just as guilty.
Let's face it, it didn't matter if the deceased hadn't try to defend himself. They were always going to shoot him before they called the police.
The story of them trying to protect the neighborhood doesn't hold together.

There isn’t any evidence on the video that the two culprits were exercising self defense. In fact, it pretty much makes clear that they were to the aggressor. The only self defense I see, is the deceased tried to save his life.

One could argue that arrests are messy, especially when you load up on a shot gun and the perps already admitted they thought Arbery was armed and dangerous. Bringing the guns to get a “bad guy” is what makes this all messy. Citizens are supposed to be arresting officers, even under citizen arrests, all a citizen can do is hold the person they witnessed commit a crime until the police show up.
Premeditated based on their own statements at this point.
But I believe, I read that they are charged with Felony Murder, which is a step down from murder, which has a premeditated requirement.
One of the problems for the people arrested, is that on the initial police report, they clearly stated they wanted to ‘stop him and ask questions’. That initial comments goes to the mindset of the situation. Either don't talk to the police, or say it was a citizens arrested because you saw the individual commit a felony. One doesn't need to ask someone questions if they witnessed them committing the crime. Also, they said they saw him prior with his hand in his pants, which they deduced he could be armed. So, they went inside their home to retrieve weapons to confront the possible armed person with.
