Interesting ... the very words from Fokker quoted by Cleveland are the potential reason for allowing Sullivan to proceed. Equally interesting is that Cleveland makes zero effort at defining “pending charges” and address whether a conviction alters that status.

Cleveland may in fact think that the charges were pending in Flynn’s case, but she is not a very good lawyer if she merely assumes they were.
