They are charged with Felony murder since they committed a felony during the process.
That isn’t an overcharge, it is the correct charge.

and how can the citizen’s arrest not be legally conducted? McM’s have called the police before. They called during this incident. They were referred to the homeowner by the police as being trustworthy watchmen. They are diligent citizen’s of the neighborhood (arbery was not).

No. There were three shots, the first shot was fired while Arbery was still in front of the truck.
The problem in the Zimmerman case wasn’t overcharging; it was the evidence. The evidence at trial showed Zimmerman was on his back having his skull smashed into the sidewalk when he shot Martin. While Zimmerman was foolish for following someone around he thought was up to no good (call the police and leave it at that, don’t ever go looking for trouble or you’ll probably find it), no crime was committed by Zimmerman leading up to Martin attacking him and trying to kill him.
The reason for the charge here is that the prosecutor alleges a felony was committed (aggravated assault) and a person died during the commission of that felony. That makes it felony murder. The only question now is whether the McMichaels were lawfully arresting Arbery. If they were, I’m guessing they walk.

McMichaels have no arresting authority, even citizen’s arrest doesn’t give anyone the authority to chase down people you think might have committed a crime someplace with guns and shoot them when your “arrest” goes wrong.

Was Travis a law enforcement officer?
Did he have training as a police officer?
What were his qualifications to be deemed a trustworthy watchman.

What will probably happen if they try to bring that up is the prosecution will cite the fact the old man, who had worked with the DA, had his gun and badge taken away because he was not mentally qualified or trained to make an arrest. Also, in 2019, in order to get a make-work desk job he signed an agreement that he would not even try to make an arrest - the county didn’t want any liability for his actions.
Because being a “diligent citizen of the neighborhood” is not all that’s required to legally chase somebody down the street with a shotgun. I think the question is whether seeing somebody walking around a construction site merits that kind of response.
The only reported theft in the neighborhood was an unsecured handgun taken from Travis McMichael’s truck months before this incidence and there’s nothing to tie Arbery to that. The owner of the home under construction has stated there’s never been anything taken from the site and there are no police reports about other burglaries or other break-ins in the neighborhood. At least, according to local news reports.

That said, when they emerge from the front of the truck, Arbery appears to have his hand(s) on the barrel of the gun. That first shot is probably the one that grazed his hands because he certainly did not slow down at that point.
