If you watch the video, it's not a construction site, it's a finished house. The owner was having some work done on it, but he lived there part of the year. There was stuff in it. And the owner reportedly had a security video of a man matching Arbery's description inside the house, walking around, looking at things. And again, "reportedly," the security video shows a man stuffing something in his back pocket in a way that suggested a sidearm. (I don't know if the man was Arbery.)
There had been break-ins in the neighborhood over the past few months, and the guys in the truck lived two blocks away. These circumstances, if true, would make their behavior reasonable, shotgun and all.
Which might be why when the McMichaelses called 911--which doesn't seem consistent with the idea that they were trying to get away with something illegal themselves--they mentioned that whoever had been breaking into houses might be armed.
If Arbery was in the house the day he met the McMichaelses, he was trespassing, which is a violation or misdemeanor. But if he was casing the joint with intent to commit a future burglary, he was committing a felony by his presence, and also committing a felony by going after the son holding the shotgun. Why? Because their action to investigate and make a citizen's arrest would have been justified.
There's another element. If Arbery was innocent of anything except taking a jog (11 miles from where he lived?) and in fear of his life, why didn't he just get his butt away from the truck by "jogging" cross-lots to escape? On the video, he expressly goes from behind the truck to the front of it to go after the son. Like a nut. Or a guy trying to silence people who saw him trespassing with intent to steal or whatever. Whether he was a professional criminal, a hothead, or just a fearful man who was "triggered" by being followed and unwilling to explain himself, Arbery worked pretty hard to get himself shot.
You know what? More than once, I've been in situations, wandering around in a strange neighborhood, where someone came up in a car wanting to know what I was doing. You know what I did? I told them. And in each case, they said, "Oh, okay," and drove off.
Whatever its inspiration, the late Mr. Arbery's behavior makes no sense to me.
“What a load of crap if he felt in danger why run to the truck and attack the guy holding a gun?”
If you have taken the time to read the police report and watch the videos, you would know that Arbery was being chased. Greg McMichaels admits to 3 separate attempts to cut off Arbery with their vehicles. It is in the police report.
When Arbery is approaching the truck, he is approaching a vehicle that has tried to cut him, and is being followed by another vehicle that has tried to cut him off. When he sees Travis McMichael standing in the street WITH A SHOTGUN... what is he gonna do? In his eyes, things have escalated very quickly to a deadly level.
This idea that the McMichaels were just sitting in the street minding their business and this guy runs up and attacks the guy with a shotgun so it is self defense is absurd.
I did not watch it, good grief watch the damn video. Arbery runs towards the truck would you do that when you are in fear?
He then runs to the right of the truck.
He then assaults man with gun.
They wrestle with gun.
shot goes off and do you go running miles in khaki shorts and those kind of sneakers?
You are parroting the words of the media
Citizen’s Arrest is for crimes that you witness or have immediate knowledge of. Not crimes you think somebody might have committed and it doesn’t permit for an armed chase/response. You are suppose to hold them until the police arrive. It is usually used with shop keepers holding shop lifters until the cops show up. It wasn’t intended for armed thugs to go around and arrest people of crimes they think they might have committed.
Big difference from what happened here.
Looking at the Georgia statutes, murder is completely justified.
Under Georgia law manslaughter is a "heat of the moment" crime of passion. There was nothing "heat of the moment" about this. They deliberately armed themselves. They followed him. They set out to confront Arbery. Except for screwing up and killing him everything was carefully planned.
You mean the guy who matches the description.
You mean the guy recording who called 911
Arbery was out for an innocent jog LOL Yea miles away in those clothes.
I see where he could have run off the road into the woods in the video but he did not he ran towards the truck.
In the end you and I were not there but to make out this was an innocent guy just out for a jog miles away from his house matching a description where a rash of robberies happened in those clothes stopping off to see a house under construction is laughable at best if not media naive.
Now if you want to talk about the cops getting fired about the black guy dying then we can talk as I think the cop was out of order. However robbing stores shouting justice is also out of order and how many black people died from a black guy , or how many whites were victims from blacks this week and not on the media.
“If Arbery was innocent of anything except taking a jog (11 miles from where he lived?)”
What is your source for the statement that Arbery was 11 miles from his home?
Reasonable suspicion which this was.
None of which were apparently reported by the owner of the site and, according to the owner, nothing had been stolen.
...and the police had advised the homeowner to contact McMichael as a former LEO to check the house if there continued to be problems?
Use it as part of the wrongful death suit against the Sheriffs Office would be my guess.
Reasonable suspicion which this was.
Which police officers can use probable cause, but citizens don’t have that authority
They had zero authority to conduct a citizen’s arrest, you have to be 100% accurate or you yourself with be charged with crimes.
Have you looked at the neighborhood on Google Earth?
Do you realize that when the McMichaels started after him, he was running into a no-exit loop?
Do you realize that the neighborhood is surrounded on 3 sides by water and swamp?
Do you know that Travis McMichaels admits to the police of 3 attempts to using vehicles to cut off a man running on a public street?
You are focused in so tightly on one small aspect of what you have seen that you are missing the bigger picture of the overall event, and how the actions of the previous 4 minutes and the situation he was in likely appeared to Arbery that he was in mortal danger as he approached that truck.
He had no where else to run.
He had turned around and run away from the truck twice before what we see in the video, per Gregory McMichael’s statement to the police. The third time, he saw Travis McMichael standing at the driver side of the truck and went to the right to go around the other side of it. He was pretty much doing everything he could to avoid a direct encounter that the McMichaels were determined to have.
They apparently believed they had cause to hold Arbery by force for the police. That belief will be tested at trial.
Look up GA law for crying out loud
He ran to the right of the truck and then charged the man yea OK that sounds like he was in fear.
“He then runs to the right of the truck.
He then assaults man with gun.
They wrestle with gun.
shot goes off”
Bullshit.
Here is a link to the video

There were three shots
1st shot at 0:20 while Arbery and the shooter are in front of the truck
After that we see them wrestling for the gun in the left lane
2nd shot at 0:24 when they are off camera to the left
Then they come back in view and are still wrestling over the gun
3rd shot is fired at 0:28
He could run off the road after still looking at the map and there is no reason to charge a man. Are you trying to say he was an innocent jogger miles away from his home matching the description of the last 2 weeks ago where a rash of break ins have happened who stopped off to look at a house in khaki shorts and that footwear?
Has the break ins stopped now?
he ran towards the guy with the gun then the shots went off good grief you spout the media if you like just before an election year.
He’s being charged for filming it?
