Apparently yes. That’s the problem: while the mob is implicitly absolved of their vandalism, trespassing, & threats, the couple will be held to high standards of what constitutes “assault” - which includes pointing a gun at others indiscriminately.

Couple will have to demonstrate a legal threat to themselves, for which the entire mob is culpable for and thus subject to legal “assault” to wit self defense in the form of direct threat of deadly force a la pointing guns.

Clarification: self defense in the form of situational assault has always been a felony, subject to exemptions.

I.E.: if you shoot someone in self defense, you’re indicted for [attempted] homicide until presenting a positive defense to wit “that’s normally illegal, but explicitly legal in this specific circumstance.”

It’s a private road, co-owned by all the property owners. The Antifas were trespassing ON their private property, which the Antifas broke the fence to get into, which makes it breaking and entering.

It would be interesting to see the details of how ownership of the private road is divided. If the home owners are responsible for the section of street in front of their house, then they own it.

A pardon doesn’t stop anyone else from being charged in a similar situation.
Letting the courts reject it, does. Or at least helps.

And it depends on the specifics.

If the protestors were just marching down a public street peacefully (doubtful) and this coupple went out into the streat pointing guns at people to intimidate them, then that’s probably a legitimate assault charge.

But if the protestors were vandalizing stuff (likely) and this couple showed their weapons to protect their property, then I think that’s a constitutional right to own and bear arms.
