Here we go - they helped to steal an election, and now stand for the proposition that if you get away with a theft for long enough 35 days), you now own you I’ll-gotten gains.

No, AP, the safe harbor means nothing - if an election result is fraudulent our Constitutional guarantee of a Republican (small “r”) form of government will override a mere federal law.

All other deadlines like Safe Harbor are superseded by the Constitution.

The constitution gives Congress the ability to set the date/deadlines regarding federal elections. Congress did so with the Electoral Count Act of 1887 - which creates safe harbor day and the electoral college vote day.

Safe harbor doesn't appear in the constitution directly, but it exists in federal law as a direct result of powers expressly granted to Congress.

Congress could, theoretically, change the law. But that's not going to happen.

Well since it was created by the Electoral Count Act of 1887.. no it probably wasn't adhered to in 1876.
