Not really. The HIPPA laws only apply to the medical professionals, to stop them from sharing your information. They don’t stop anyone else from asking for it.

Now, employers can’t discriminate based on a disability OR a pre-existing medical condition. I’d say being unvaccinated is a pre-existing medical condition, so they shouldn’t have any right to treat you any differently than anyone else based on that. But that’s just my opinion, someone would have to get a court to agree on that point before it would become “law”.

Ask yourself: When is the last time the Roberts-led court has made a brave decision? Not a right one or a wrong one, just one that would take courage to make in the current zeitgeist.

Maybe I’m just forgetting something, but I’m drawing a blank here.

No, they’ll make it as onerous as they possibly can. The only reason they put the testing option in at all is to protect the rule from being instantly struck down by the courts, since some disabled people cannot take the vax, and if you don’t provide an accommodation for them, the rule would be invalid on its face, since it would conflict with existing ADA and other laws.

The Labor Department is taking feedback over the next month on whether smaller workplaces should be included.

Maybe antifa/blm will give them some "feedback".

But this a Regulatory mandate.

OSHA rules are typically extra judicial and not reviewable, just like the EPA rules.

HIPPA doesn’t do anything, and denying employment over medical issues is done legally all the time.

If job X requires you be able to ABC, as long as it is consistent it is ok.

I know companies that have tested for nicotine during drug tests and fired people that were positive. Note, if it was cocaine you had the option for treatment but tobacco it was out the door.

Yes, but nobody needs a vaccination in order to perform any job, so there’s no argument that an accommodation can’t be granted, which is an important legal point.
