I guess the unknown journalist who wrote this had no idea the word "conscious" needed to be "conscience" to make sense let alone be correct. The wrong word in both the headline and article on MSNBC is still up today without correction even after comments were left on YouTube. Beyond pathetic.

Perhaps Justice Sotomayer is the “conscious” Freudian slip of the Supreme Court. Conscience has nothing to do with her rulings or application of existing law.
The very quality of law is strained. Certainly credulity is.

I suppose Sotomayor could be considered the “conscious” of the Court by liberals because she is less brain dead than Breyer (who is 83) or Ruth Buzzie Ginsburg (who is still dead), but I don’t know what Kagan could have done to piss the liberals off.
