A court decision for which the practical effect, is to allow states to make decisions about an issue through the legislative process, is an attack on democracy, an attack on human rights, an attack on women’s rights, an effort to turn back the clock, etc. etc.

if USSC says its a state issue how can FEDGOV codify without a constitutional amendment?


Even if SCOTUS doesn’t say it’s a state issue, how does Congress ‘codify’ it? Nowhere in Article 1 Section 8 does Congress get the power to codify anything about abortion. Abortion has nothing to do with interstate commerce, the national debt, treaties with foreign nations or Indian tribes, coinage, weights and measures, the national defense, etc. etc.

Roe claimed that abortion was part of a ‘right to privacy’ implied but not actually stated by the 4th Amendment and therefore the states could not restrict it since Constitutional guarantees supersede state laws. An odd ruling since this ‘offense against the ‘right to privacy’’ went undiscovered for nearly two hundred years.

He won’t. Schumer won’t even have the support of every Democrat. This is just election year blustering.

And anything the Senate tries to pass will immediately face judicial review.
