No, I didn't read the decision, just some of the discussion here on FR.

Did the legislature really define any invertebrate as a fish? But fish are vertebrates (with the exception of silverfish).

Yes, they really did. They were trying to get bone fish, amphibians, aquatic mollusks, aquatic arthropods, aquatic gastropods, etc. all covered under the term “fish”. Somewhere in the definitions, though, they put in “any other invertebrate” ... Boom! Insects, spiders, etc. even though thoroughly terrestrial are FISH! Ahhhh, the unlimited power of the Almighty Legislature!

What’s the court to do? Their job is to enforce and interpret the law, not to write it.

Thank God 5 normal people voted against the elephant. Otherwise, it wouldn’t be just one 50-year-old elephant that won its liberty in New York. Once word got out to other elephants around the world there would be a caravan of them heading to cross our southern border. Then they will be placed on planes and spread out all over the country. Next thing you know you’ll have an elephant looting just under $950 of nuts from your local store.

Why doesn’t the legislature decree that pi from now on will be exactly 3.0? That will make a lot of calculations easier.

Everyone seems to be missing the most interesting part of this story.

How can any human have “standing” to make a case for animal rights?

Remember—the courts love to play the “standing” game to dismiss cases they don’t like—this is a blatant case where no human should have such standing.

If the elephants want to be free, then let them march into the courtroom and make their case.

If the courts refuse to hear it, then the elephants should parade outside the judge’s home in protest.

Alinsky’s Rules for Radicals applies to elephants too!
