In Texas the insurance company would interplead the policy proceeds.

Interpleader is a process where one who holds funds they do not own, and is not certain who the lawful owner is, deposits the money with the court, and files a lawsuit naming the potential owners that basically says "I don't want to guess wrong about who to pay this money to, and have to pay twice, so you guys fight it out among yourselves."

Texas law does not allow an individual to collect life insurance proceeds for someone they have murdered, but years may pass between the death, and conviction, so insurance companies will typically interplead the money if the death is suspicious.
