Question: if Trump instantly declassified everything in his possession after his presidency, would that material be subject to FOIA requests?
The recording itself is not hearsay.
Disagree. The cases are weak …. All of them, especially this one. Trump will be fine and fortunately unless he dies Biden will run against him. Neither one needs to worry about the classified docs they had. Lots of noise , trying to sway public perception… as always , like literally every other case theyve brought.
DoD the anonymous sources specify what those limitations are?
Sorry.
Just by leaving the White house in Trump’s possession they are automatically declassified
I notice the stuff in question concerns Iran. The Democrats are scared schnitless of anything coming out about their dealings with Iran.
Im sure its not as cut and dry as that because actual law and precedents are routinely ignored for political animus. So we’ll get a loud drawn out fight from DOJ but ultimately a fat nothing.
DJT *will* be charged on this...we all know it.The DC jury will be seated around August of next year.
Not classified if he kept it. And how about the leaks?
do they have said document??? feh...
We are much more tired of your pretentious posts.
Are you saying that any document removed from a government facility by a president is automatically declassified???
They aren’t classified you CNN idiots.
Heard it from a friend who heard it from a friend who heard it from another....
Not just me.
Mark Levin said it too.

2. The former president has the legal right to access any and all of the documents created during his presidency, classified or otherwise. Moreover, the second before he left office, by his very actions alone in taking the documents, it can be said that he declassified them.— Mark R. Levin (@marklevinshow) August 26, 2022
Again, who is leaking from the Special Prosecutor’s office? Just like the Russia-Russia investigation, the leaks are anonymous so that they can not be verified and just juicy enough to get 24/7 speculation of Trump being guilty of “something”, “anything”, too tarnish him for 2024 and to condition the people that Trump is not fit to hold office.
CNN did not listen to the recording but others say...
The President maintains his clearance after leaving office. There would be no need to instantaneously see declassify everything he left with as long as they were stored properly. Furthermore, declassified documents are probably open to FOIA requests which I don’t think Trump would like. Trump did nothing wrong regarding these documents, but walking out the door with them does not declassify them.
The President can absolutely declassify any document, without question. He can literally wave his hand over a document and say "declassified" and it is so.
My point is that he can also remove classified documents WITHOUT declassifying them. So a former President can have Top Secret documents at his house and it can be absolutely fine. There are Top Secret documents stored at hundreds of facilities throughout the country.
Your original argument was that the removal of docs from the White House means they are automatically declassified. That would be a huge security threat.
