Failure to file a 1099 on the $4000 that was given to the landscaper.

Tax evasion. Lots of contractors do this. Project will cost X if paid in cash, X+Y if by check or any other traceable means.

Not tax evasion by the customer, who wants a better deal. Same goes on at stores and restaurants. We always pay in cash, many clerks say they have to pay 3% or more for credit card fees so they discount if you pay in cash. If a contractor gives a discount, who are we to blame him while he avoids nasty paperwork accounting.

There is no difference to the payer if he uses a check or cash as far as the law is concerned. The only reason to use a 1099 is if you want to use it for taxes. I can not understand the thinking of some people here that are astonished that Americans around the country still use cash to pay bills.

Bill has 2 serial numbers, one on each half, all of one serial number and part of the other gets a replacement

As someone who has had too many unscrupulous contractors, who lied, did absolutely egregious work that I had to redo, and in one instance actually started my house on fire, I have zero desire to help them avoid paying taxes - even if it increases my price for the work.

You only issue a 1099 if you're operating as a business, for activities related to your business. So a personal expense, on a non-business owned property, wouldn't require a 1099.

Sorry to hear of your problems with contractors. I keep a close eye on them, and have had to call the contractor back when his workers are incorrectly doing the work. Rather than lying, shortcuts are taken. So yeah, I’ve had some redo the work. Try not to pay more than for the materials up front, with the balance paid on completion. And get written contracts with details on the work.

My wife was just telling me earlier today about her friend’s son who did extensive work on someone’s home, and they reneged on promised payment, offering a fraction of the promised fees. All verbal, nothing written. The guy went back and ripped out all the work, damaging the home. Bad characters on both sides.

Let the buyer beware, it’s a crapshoot out there. That’s one reason I try to do as much of the work myself when I can.
